This, since in the Law on Salaries in the Public Sector, which is expected to start implementing in November, it is said that “if the public official resigns then it does not belong to the transitional payment after the end of the” post.
This confirms for Radio Free Europe, Deputy Public Administration Minister Hajredin Hyseni.
“So says the new law, but we need to inform you that the new law goes into operation in November and by that time it is worth current law”, Hyseni says.
Ramush Haradinaj resigned from the prime minister's position, and according to the Constitution, the government in this case falls.
The Kosovo Assembly is scheduled to be distributed on 22 August. However, since the date of early elections will be set after the distribution of the Parliament, then it cannot be said whether the country will have new Government before November 1st, when the Law on Salaries in the public sector begins to be implemented.
What does the law say?
The law on salaries and in the public sector, in addition to the officials who resign, does not provide the right of transitional payment even to officials who are dismissed from office for legal violations, then if after the end of the mandate, they exercise any function for which they are paid from the budget of the Republic of Kosovo, as well as if the officer with the decision of the cut form has been convicted by the tribunal of a criminal act committed during the time it has carried out the post, or during the period of receiving benefits.
The law envisions that after the end of the mandate, the prime minister will enjoy transitional compensation for five years worth 70 percent of his last basic salary, an assistant, a driver, an official car, and a furnished office.
Deputy prime ministers and ministers, who after the end of the mandate do not realise any entry from the state budget, have the right to pass-by compensation for one year, worth 70 percent of the salary.
Meanwhile, deputy ministers, after the end of the term, have the right to pass-by compensation for six months, worth 70 percent of the salary.
To enjoy material compensation, the deputy prime minister, ministers and deputy ministers must have exercised at least six months of regular mandate.
The outgoing cabinet has 21 ministries, five deputy prime ministers and over 80 deputy ministers.
