Artificial heights against municipal officials in Prizren for abuse of position

The Constitutional Prosecutor in Prizren ) the Randa Crime Department has filed charges against Mr.A., in the quality of Ud. Director of the Directorate for Economics and Finance in the Prizren municipality, and E.S., in the quality of the Director at the Directorate for Economics and Finance in Prizren, for criminal work “The use of official position or authority (4)x2> by Article 422 paragraph 1 related to paragraph 2, submargraphy 2.2 of the Republic of Kosovo Penal Code (KPRK).

According to the indictment, the first indictee, Mr.A., in January, December 2015, in Prizren, in the quality of Wood. Director of the Directorate for Economics and Finance in Prizren municipality, exploiting office or official authority, exceeds his official competencies by misusing public wealth, in order to benefit any benefits for other legal persons: TV Opinion, TV Besa and TV Prizren, failing to fulfill the task stipulated by law. In that way, without any tender procedure contrary to the Public Procure Law, the Law on Public Finance and Responsibilities, as well as Treasury Adjusts contracts for the delivery of advertising points for the needs of the Prizren Commission's Finance Directorate, with TV Opinion, TV Besa and TV Prizren, so that the three televisions total up to 11800 euros a year. &nb sp;

While, the second indictee E.S., in January (December) 2016, in Prizren, in the quality of the Director of Economics and Finances in Prizren's municipality, using office or official authority exceeds his official competencies by misusing public wealth in order to benefit whatever benefits for other legal persons: TV Opinion, TV Besa and TV Prizren, failing to fulfill the task prescribed by law in the manner that saw any tender procedure in opposition to the Public Procurement Law, the Law on Public Finance Management and Responsibilities, as well as the Treasurer's Order, in that without any tender procedure, links contracts to the broadcasting of advertising points concerning the senbilisation of public opinion about property payments to the Prizren Committee. The same contract I have with TV Opinion, TV Besa and TV Prizren is that for three televisions it's equal to 11,800 euros a year.

With these actions, there is good-based suspicion that the defendants, Z.A., and E.S., have fulfilled the elements of the criminal act “Kequisition of official position or authority” according to the KPRK.

The prosecutor of the case in the case of an indictment, has proposed to the court that the defendants be found guilty and condemned by law for the criminal act that he is charged with.
