If it continues ahead with this plan, the government meeting would be held a week after Haradinaj, in the same country, resigned irrevocable from the prime minister's post.
Article 95.5 The Constitution says that with the prime minister's resignation, the government he or she leads collapses altogether.
“If the prime minister resigns or for other reasons, his/her post remains at large, the government falls and the president of the Republic of Kosovo, in consultation with political parties or the coalition that has won the majority in the Parliament, mandates the new candidate, to form Government”, says Article 95.5. of the Constitution of Kosovo.
The constitution does not provide deadlines for the mandate of the new prime minister, in the event of the prime minister's resignation.
Awareers of the circumstances say Kosovo has no government, following the prime minister's resignation, and that Haradinaj is not in office.
Analyst at the GAP Institute Bekim Salihu, in a clarification of Koha.net, said the prime minister's “in resignation” does not exist and that Haradinaj is former prime minister.
Salihu says that only at Article 100, point 6, it is said that “if the no-confidence motion is voted for the Government as a whole, the government is considered in resignation”.
Even analyst Albert Krasniqi has said the government has fallen.
The constitution is contrasting between the occasion when: 1. The prime minister resigns; and 2. The no-confidence motion for Government is voted. In the first case, we have no Government at all, the posts are empty, ministers, deputy ministers and their advisers must immediately release their positions. This government cannot make any decision. In the second case, the government is considered in resignations, but exercising tasks until the new government is elected. Government components on the run are not legally limited. Ramush is not the prime minister in office, but former Prime Minister” has discouraged Krasniqi.
Haradinaj will return immediately from The Hague and has said that, upon returning, he will enter the political race for new elections.
