Kosovar is divorced by Swiss mistreating, court continues permission

Lucerni authorities had wanted a Kosovar woman, following her divorce by a Swiss citizen, to remove her permission to stay in Switzerland. But since violence has been exerted on the two of them, the case should be considered again, more detailed.

In normal circumstances, when the crown breaks between a stranger/e and a Swiss/shea, the permission to stay in Switzerland for the stranger/in, writes the Louzerner Zeitung newspaper.

 

 

One such case had happened in the Bureau for Migration of the Lucern Canton, when Kosovar, who had asked for his residence permit in July 2016, had been rejected. The Department of Security and Justice as well as the Canton Court have supported this practice.

But now the Swiss Federal Court, as the highest degree of justice in the country, has rejected the Cantonal Court's ruling, so that the woman from Kosovo, at least for the time being, can continue to stay in Switzerland.

Kosovar had come to Switzerland in February 2014, and yet three weeks of her stay here had been married to a Swiss citizen. The marriage was broken two years later. In this case, family violence was found. For this reason, the woman had filed charges for her former husband, records albinfo.ch. She accused him of beatings, threats and austerity.

According to the Federal Court, it should now be clarified whether Kosovo at the moment of partition was facing a dilemma amid the impossible continuation of married life and the completion of its right to stay in Switzerland. The Cantonal Court has failed to clarify whether there was domestic violence, and if so, to what extent it has been present.

In this case, the court mentioned must present the process. Until that happens, Kosovo can stay in Switzerland.
