Haradinaj with zero competence keeps the government's outgoing meeting tomorrow

At the start of 2:00 tomorrow, the government's regular meeting will be held at the invitation of the prime minister to resign, Ramush Haradinaj.

However, the call for keeping the cabinet's meeting in which decisions will be made is unconstitutional, since, with Haradinaj's irrevocable resignation, the government has fallen.

Recognition of constitutional issues, Mazum Baraliu, has said the prime minister in his resignation, Ramush Haradinaj, can only call the government's meeting for administrative and technical work, but not to make decisions.

“It can hold the Government's meeting for technical administrative work, but the decision making is indisputable if judged on the provisions of Article 95 of the Constitution of the Republic of Kosovo. The government, with the resignation of the prime minister, falls the Government, and if a fallen Government makes valid decisions within the mandate as if it were within the mandate, it is something that in constitutionally-juridical terms is disutual. They need to analyze them well and then explain their actions. It is their job to do what the government cabinet and the currently irrevocably retired prime minister did, but in terms of constitutional-juridical any activity the same as the one before the resignation is disutibly in the constitutional-juridical aspect”, Baraliu has clarified the news.net.

In addition Baraliu has said that each institution should act within constitutional and judicial frameworks, since our country lacks the Law of Government and in the absence of this law, constitutional and legal provisions should be respected.

He stressed once again that the Government of Kosovo, with Haradinaj's irrevocable resignation, is currently out of constitutional and mandated office and thus cannot make decisions.

“Each institution must act within the frames and authorisations it has within the constitutional-juridical mandate and under the Government Law. We had to have a Law of the Government where these things should be assigned. No Government before this already fallen government and neither has the Government completed the Law on Government, has started but has not delivered it to the Parliament, has adopted the Law Framework for Government, and therefore needs the constitutional standard that I mentioned above to be observed, and this Government knows it is the fallen government, so the government that has fallen and is not constitutionally mandated, so within the mandate, but has fallen down and is withdrawn. She practically has the right to perform technical-administrator work, but not to make decisions”, Baraliu stressed.

The Constitution of the Republic of Kosovo, Article 95, Point 5, says: “whether the prime minister resigns or for other reasons, his/her post remains at large, the Government falls, and the president of the Republic of Kosovo, in consultation with political parties or the coalition that has won the majority in the Parliament, mandates the new candidate, to form Government”.

We stress that, based on the document that has been made public in media, a cross-point agenda is also a review of the proposal for the appointment of members to the Kosovo Civil Aviation Authority Board (MIT).

All the agenda points for tomorrow's meeting are decision-makers, and in this way Haradinaj is committing legal and constitutional violations.

Following Haradinaj's call for holding tomorrow's meeting, Kosovo Parliament deputies have also reacted, calling it a scandalous and unconstitutional decision.

Otherwise, last Friday Ramush Haradinaj has resigned irrevocable from the prime minister's post following the invitation he received from the Special Court in the quality of the suspect.

Meanwhile, yesterday he at The Hague has been interviewed by representatives of the Special Chambers, but Haradinaj has agreed to defend himself quietly.
