Civil society envisions the breakup of the Parliament

Following Ramush Haradinaj's resignation from the Kosovo prime minister's post, the attention and demands of parliamentary parties were led by President Hashim Thaci for setting the date for early elections.

Although the latter is still remaining silent on this subject, the one who thwarted Government by resigning has now officially announced coalition partners and the heads of institutions for its irrevocable resignation.

He has also called for immediate elections based on the applicable laws of the Constitution.

And the possibility of a technical government was rejected by a voice from all parties, which called for new elections.

Such a request as appropriate is being seen by Taulant Kryeziu of the Epic Institute.

It for Koha.net says the right path is to dismantle the Assembly with 2/3 of the vote and set the date of the elections.

According to him, this is the only step for urgent re-legigration of political forces.

Kryeziu adds coalition PAN has completely lost its legitimacy and will not be able to use another candidate's option.

He emphasises that two clear platforms must go to elections.

Meanwhile as a second platform, Kryeziu says those who are promoting the fragmentation of Kosovo should seek legitimacy on the issue.

Let all who are promoting the fragmentation of Kosovo stand forth and let them go to the sovereign for legitimacy on that issue. You can't ask the government for votes and bargain with the territory. Therefore, the only road and only alternative is the dissolution of the Assembly and the president appoints the decree for early elections”, he points.

According to him, in Kosovo's governing system, there is the Assembly, which determines the time when it takes place in the election, while the president has only the role of consulting and then, after self-determining, only to set the date for new elections.

He adds that there is no alternative to coalitions, and according to him, each other is out of constitutional and judicial logic of continuing the mandate.

This coalition has lost its legitimacy”, he says.

Meanwhile, former Kosovo Constitutional Court justice adviser Durim Berisha, an article concerning the situation created following Haradinaj's resignation, has said the current Constitution of Kosovo has defined the Parliament as the only institution which is legitimised through direct elections.

He says the Assembly is the link between the sovereign (people as a whole) and other constitutional organs, thus building what is known in it as the “position of constitutional legitimacy”.

“Being the only constitutional body to which the sovereign legitimizes, the Kosovo Assembly represents the era of our constitutional system, and the electoral process can only be linked to the mandate of the Parliament (the fair elections of the Parliament four years after its constitution) or the failure of the latter to fulfill its constitutional functions”, he has said.

Time.net has consistently tried to receive answers from the presidency to understand when it will gather political parties to set the date of elections, but they have not been accessible.

We remember that Prime Minister Haradinaj said he resigned on 19 July after the Special Court's invitation, with the reasoning that he wants to testify there as former soldiers, not as prime minister.
