"Burdushi" requires retrial, while the Prosecutor's Office requires harsher punishment

On the other hand, the prosecution is calling for Appeals to rig the conviction pronounced against Peqan, arguing that the same was not due to the weight of criminal activity.
Their requests were reviewed Monday at the Appeals College session, reports the “Justice Vow”.
The Constitutional Court in Prizren, on November 19th 2018, had taken on trial, with which the accused Peqani was convicted of fraud and sentenced to one year imprisonment and 500 euros in fines. The court had also pronounced a supplementary sentence on him, a ban on the practice for three years.
Disgusted with the court's ruling, the prosecution had filed a complaint, with the claim that the conviction pronounced has not been attributed to the weight of the criminal act, and that, according to the prosecution, with the stated sentence, the purpose of the sentence will not be achieved.
The complaint against the verdict had also been exercised by the defender of the accused Peqani, lawyer Asdren Hoxha, on the claim that the indictment was involved in procedural violations of legal provisions, criminal law, mistaken confirmation of the actual situation and the height of the sentence.
The first degree court reportedly had taken into account only guilty evidence, and that the court's purpose has been persecution and not the conviction of the accused, since, according to lawyer Hoxha, the court-set sentence is very high.
On these claims of convict Pekani's defender, it is calling for the annulment of the first degree decision and the return of the case to retrial.
The same claims had filed complaints with the other defender of the accused Peqani, lawyer Skender Morina, reports “Justice bet”.
At the session, he also introduced the injured Qazim Pulitan, who prior to the college led by Judge Hashim Qolaku, claimed that he joined the prosecution and filed a wealth of legal demand.
The Constitutional Prosecutor in Prizren had filed charges against accused Hysni Peqani with the argument that the same person, on June 20, 2014, until August 12, 2014, in Prizren, in order to hide the facts and illegally gain rich benefits for himself or the other person, cheats and puts the other person under his care and thus urges him to damage Qazim Pulatani, telling him that he would heal his wife who suffers from depression in compensation for the amount of 2000.
By these actions, Pekan is accused of committing criminal fraud.
