The audience has found that an ambassador who was appointed by 28,06,2013 through the decree of the president continues to exercise the ambassador's duties and receive wages on the same mission, even though there is no act to continue the length of his stay on that mission.
The salary received by the ambassador in question in 2018 is 53 thousand and 21 euros.
Based on the Law for Foreign Service of the Republic of Kosovo, Article 22, however, diplomatic representatives remain in service on the same diplomatic mission for a four-year period, or as required to meet the needs of the Ministry.
Under the same law, the possible extension of the mandate is in the ministry's discretion.
Foreign Minister Pacolli's adviser, Jtlir Zyberaj, has indicated that it is the ambassador of the Republic of Kosovo, Ramadan Avdiu, who, according to him, was appointed by the president's decree to lead the Kosovo mission in Geneva.
This is the ambassador of the Republic of Kosovo, Mr. Ramadan Avdiu, who is appointed by decree by the president to lead the mission of the Republic of Kosovo in Geneva. In this regard, I would like to explain to you that neither the Foreign Service law nor the Foreign Ministry Law and the Diplomatic Service have specified the mandate of the mission's chief (ambassendor) on a relevant mission, especially in cases when it is appointed by the decree of President”, Zyberaj has said about news.net.
According to him, the Ministry of Foreign Affairs has repeatedly announced the presidency when there have been such cases.
He says the president's appointment decree does not address the issue of the ambassador's mandate.
“also, the decree for appointment of the president of the Republic of Kosovo does not address the issue of the ambassador's mandate in the case of his/her appointment, as in this case. The Ministry of Foreign Affairs has announced the ongoing presidency when there have been such cases, as well. I want to explain that this find has been continuous and not just this time. This is because the Law and Sublaw Acts (the Foreign Service regulation) left vacuum in this regard”, he said.
Zyberaj has clarified that the MPJ does not operate for the withdrawal of any ambassador unless there is a decree to do so.
The Ministry of Foreign Affairs, even in this case, does not act, if for an ambassador, there is no decree for his withdrawal (in concrete case there is no decree for withdrawal from the president). This legal vacuum has been addressed in the new Foreign Service bill, which has been handed over to the assembly. In the event that this is done under new law, the Minister of Foreign Affairs has created a working group for drafting the new regulation for the Foreign Service, where, among other things, this issue will be settled”, have been clarified by the Ministry of Foreign Affairs.
