Commission for Victims of Sex Violence drags the process, victims in dual anxiety

By February of last year, since the Commission for Verification of the Status of Sex Violence Victims has begun, about a thousand and 100 people have applied for that status. Less than half, however, have begun to enjoy these contributions. Retirement as a victim of sexual violence has been taken around [...]

Kosovo institutions are working very slowly to verify them, much less to punish the perpetrators of the work. At least that's what organizations that deal with these cases say.

The director of the Kosovar Centre for the rehabilitation of Torture Survivors, Feride Rushiti for KosovaPress, says the process of legal recognition of this category is going too slowly, for which, according to her, victims are experiencing double anxiety and tension.

“Practically some concerns have emerged, and some challenges that are delaying the process and decision-making, since we have to do with 20-year-old wounds, normally it's not easy, but I think these challenges in the process need to be dealt more seriously with for the fact that there are victims waiting a year for this process, keeping them in tension, holding them anxious, making it difficult for him, but also decomposing others for appliance. So, if we as an organization and as a society and policymaker are thinking that this issue is going a little late for addressing even Belgrade level, in dialogue, but even further away, this mechanism that the state has created to help is going a little late for what it's making it difficult for you to have a body, says Rushiti.

For cases that have been denied the demand for status, it says that come mainly from other sources as a case, not through organisations, or lack of sufficient evidence.

In such cases, the challenge for victims is the confrontation with the courts.

According to Rushiti, the process through the latter is undermining even more victims.

It has demanded that the period of review of these complaints be over six months at the most, not as a practice for years.

On the contrary, victims will not be able to apply for the second time. But even presenting itself to courts is a concern for organisations and the victims themselves.

In the court we were rightly told even when we met the leader of the Constitutional Court, from here when people should be named after. As long as they're protected as documents with the law on data protection, they're classified documents, they have to figure out how to go through codes, that Kosovo's a small place there in the sports may be a relative of a person who might complain “, she claims.

According to Rushiti, the compiled form is also a trauma to the victim himself because, as such, it returns them in time, thereby remembering the crime scene, present persons, and also the horror experienced 20 years ago.

The case of complaints and court appearances is also concern for the ombudsman, Hilmi Yashari.

Among other things, he says, other complaints in decisions being made by the commission have been acknowledged as an institution.

The communication of authority and the side is not discussed that they should be open, because it is about the status of the person. Publishing data eventually has to do with the third parties to be involved in the process, which may be ordinary citizens or an authority. And if they're handed over here then it's about violating this right, but never in agreement with the commission or... yet there are techniques that enable an easier co-ordination, to keep from the eventual pressure that can happen if they have to physically appear before the” courts, says Jashar.

During this process of legal recognition of victims of sexual violence, Jashar says that the perpetrators of the work have also been identified, as he said they have recommended to the commission that immediately submit to the State Prosecutor and exercise criminal gossip.

The complaint about the commission's work has the very survival of sexual violence, Vasfije Krasniqi-Goodman.

According to her, the five-year limit, as is the mandate of this commission, is unnecessary.

The “The jobs are going very slowly, it's already been only 14 months, 1,000 applications have been submitted so far, not even 500. So they're going too slow. It's also about verification, it requires a lot of statements, a lot of evidence that happened 20 years ago. I'm faced with the evidence that I've been looking for. Even though there are all documents in three Kosovo trials. They wanted to get witnesses back. The commission needs to be trained to behave better with the victims, but even faster with the process”, Krasniqi-Godman says.

Commission for Human Rights, Gender Equality, Ungenerated Persons and Petitions member Teuta Haxhiu estimates these delays are related to the commission's negligence.

I still say today is a very slow job. As long as we've been looking at the law first for violent cases, but at the same time everything has gone into government and budgets, now we have a commission that really works very slowly. In terms of their professional engagement they've said a few times on the commission, but to me it's completely insignificant if they're too loaded, it's better to be competent people by not opposing their competence, but just in time how long they have time to work to look at cases that are violated. It is simply a huge neglect of the commission, if the commission has not asked our commission even a single letter to require either to meet any demands so that the case be considered as soon as possible”, it states.

It calls on the commission for verification to address the gender equality commission in order to work jointly in meeting their needs, their demands, in order to speed up examination of cases.

Despite this, the ambassador of the United States of America to Kosovo, Philip Costnet, has questioned that it can be manipulated even in the case of the benefit of victims of sexual violence during the war.

A law that was written with a good purpose, but there have been obstacles from politics. Change of Law, 2014 for the status and rights of martyrs, disabled, veterans, members themselves The KLA and civilian victims have granted official status to survivors of sexual violence during the war. Through bold testimony to survivors such as Vasfije Krasniqi Goodman and others, survivors have begun reporting 20 years after the fighting and they have exceptionally creditd for turning a significant idea into law, but this amendment has been attributed to a status that denies granting status to people affected after June 1999. Organizations working with survivors have clarified this during the time this Law was adopted... could the Parliament be persuaded to change this law, to serve all victims, and, like that, will I give the assembly of survivors of sexual violence the same social and financial benefits as the real and fake KLA veterans, whose numbers have been added in a very suspicious manner, he says.

Mini Begaj Balaj, who heads the status check of the victims of Sex Violence, has been contacted for several weeks by Kosovas has not been available.

Otherwise, in the last war in Kosovo, it is believed that some 20,000 women, girls, men and boys have been sexually violated, and during these two decades of horror they have experienced have shown only two thousand of them. And not one of the wrong-doers can be punished.
