(7 years ago)The Court of Appeals has stiffened the sentence from six years to 10 years in prison, accused M.M. The latter was found guilty by the Constitutional Court in Pristina late last year for the criminal work “
The latter was convicted on the part of the Constitutional Court in Pristina late last year, for the sexual use of persons in 16 years” by Article 253 of the Republic of Kosovo's Penal Code.
The court found that, now 85-year-old from Pristina, in 2017, using her fragile age and without her desire, had had sex with a minor, 13-year-old, who was later found to be pregnant, and because of the risk of pregnancy, had had to abort her.
The College to Mitur of the Court of Appeals estimated that the 10 years in prison against the accused is a just and legitimate sentence, in harmony with the weight of the criminal work, the circumstances under which it was carried out, the consequences, qualities, and degree of responsibility of the accused, the Court suggests.
The college also estimated that the most envisioned goal will be achieved on this criminal sanctions.
