Admovere: Appeal overturned the Foundation's decision on Madi Bektash's plagiarization report

The Admovere organisation has announced the Act on the Court of Appeals' Act, which undermines the Constitutional Court's decision to remove Professor Maydi Bektash's plagiarature.

Admovere, in the announcement, says that yesterday on March 26th 2019, the relocation hearing was held in connection with Madi Bektash's request for the deployment of the security measure to the Foundation Court in Pristina, while the next session will be held on 24 April 2019 at 13:30.

We remember on September 21, 2018, ADMOVEN published the report «ACADEMIC STAPIF I UP'S studies, other commitments, plagiarizations, assessments and proportional staff». One of the goals of this report, according to them, was the listing of all cases of plagiarization of MP academic staff members, which were reported to the media over the years, since the very establishment of the UPI.

On September 21, 2018, ADMOVEN published the report «ACADEMIC STAPIF I UP'S studies, other commitments, plagiarizations, assessments and proportional staff». One of the goals of this report was to list all cases of plagiarization of members of the UPP academic staff, reported to the media over the years, since the very establishment of the UP. After the release of our report, on October 1, 2018, Professor of the Faculty of Jurydice, Mr. Majid Bektash, indicted us for slander, and the Constitutional Court in Pristina on November 8, 2018, approved the security measure demanded by the plaintiff, which we were forced to withdraw part of the report discussing him, as well as not to make statements about his personality until the court makes the final decision.

We as ADMOVERE carried out the court's ruling, despite considering it an unfair restriction to freedom of expression, and removed the part of Mr. Bektas. However, on November 16, 2018, we filed complaints against the C.n.2884/18 Constitutional Court Act in Pristina for the appointment of a security measure and asked the Court of Appeals to cancel the decision because during its release the court: 1) has made substantial violations of the contextal procedure provisions, 2) has wrongly ruled out the actual situation and 3) has wrongly implemented material right.

The Court of Appeals on February 28th, 2019, received the Act on Actual Ac.r.5022/18 for the collapse of the Constitutional Court's Act on the appointment of security measures, dated November 8, 2018, and turned the case into a re-placement of the Foundation Court. The Court of Appeals found that our complaint is based and found that the Act on the appointment of security measures has essential violations of the contextial procedure provisions, that wrong application of material law has been made, and that the actual situation has not been proved directly and in full measure.

Yesterday, on March 26, 2019, restoration hearings were held regarding Mr. Bektash for the deployment of security measures to the Constitutional Court in Pristina, meanwhile, the next session will be held on 24 April 2019 at 13:30. The Council of Israel's decision to defend freedom of expression in our society is seen as evidence that courts in Kosovo are willing to commit to protecting freedom of expression.
