On this issue, lawyer Artan Cerkini has said that the Specialised Prosecutor's Order had violated certain fundamental rights guaranteed in the Constitution of Kosovo.
In an interview for public television, he has said that in addition to the suspension, he has called for complete abolition of this decision.
“The Constitutional Court of Specialised Chambers has decided to temporarily suspend the Specialised Prosecutor's Order, for this decision states that this order can seriously violate constitutionally guaranteed rights and the European Convention on Human Rights. On the basis of a prosecutor's order specialised by my client has been asked to bring him documents, and other evidence as a photograph, because if he doesn't act that way, he might be subject to some procedure sanctions”, Cerkin said.
On the other hand, it shows how the Constitutional Court, headquartered in The Hague, addressed the case.
This order has been contrary to the Constitution and the European Convention, so I have addressed the Constitutional Court with headquarters in The Hague, with a constitutional petition, and I have demanded that this order be suspended and abolished once it conflicts with provisions. The order in question violates a set of rights, unfairly violates the principle of innocence, removes the burden from the prosecution to the defendant and violates the privilege of incriminating”, added Cerkini./ P ERISCOPIA
