Public sector wage law sent to Constitutional

In general, the ombudsman considers that the Law for Salats in the Public Sector and Addixa one of this law has failed to carry the constitutional spirit in the sense of sharing powers, pre-law equality, or guaranteeing property rights.

Furthermore, the ombudsman considers that this law is out of harmony with the principles of rule of law because of shortcomings in the sense of its clarity, accuracy, and predictability.

The ombudsman has accepted 35 complaints from various subjects of the public sector filed against the Law on Salaries in the Public Sector, including complaints from employees in health, education, police and civil service.

The ombudsman has also demanded that the provisional measure be imposed on the implementation of the Law on Salat in the Public Sector until a final decision by the Constitutional Court, assessing that establishing the provisional measure is necessary to protect public interest and avoid irreparable damage that could be caused by implementing this law.

Taking into account the fact that there are a large number of complaints from various subjects of the public sector, the Ombudsman considers there is public interest that the compatibility of this law with the Constitutional Court is assessed, the Constitutional Court's announcement concludes.

The ombudsman remains committed to independently addressing the concerns of the citizens of the Republic of Kosovo in the function of carrying out his commands defined by the Constitution and by law.
