The murder of the brothers in Decan, the witness says he saw one accused of shooting at the victim.

Such a statement, witness Ramaj has given during the retrial hearing, which is under way at the Constitutional Court in Pec, where serious murders and illegal weapons are being charged by Sali Lusaj and Durim Lusaj.

During Lusaj is accused of being deprived of Rexhep Ramaj on 25 August 2016, in the village of Schuptej in Decani, following a preliminary dispute.

The same after having deprived Rexhep Ramaj of his life, along with Sali Lushan, is also charged with killing Burim Ramaj, as well as with firearms.

Witness Mete Ramaj, at the retrial hearing, has said that as for accused Sali Lusaj, he had only looked at him with guns in his hand while fighting the late Burim Ramaj now, but denied seeing him shoot.

On the other hand, defendant Sali Lusaj's defender, Kosovo lawyer Kelmendi, has considered such a witness statement contradictory to the fact that, according to her last review, he had declared that her client had not seen weapons in her hand.

However, the Ramaj witness, has declared, remains close to his statement, that he had seen defendant Sali Lusaj, with guns in his hand, but that he had not seen him firing.

Among other things, the witness has said that the late Rexhep Ramaj had sent him with his car to the hospital, while at that moment he had not noticed there had been signs of life.

He added that while he had gone to get his car to help the late Rexhep Ramaj now, he had heard more shots.

In this trial, the witness's quality has been heard by witness Rame Ramaj even after the defendants' defense attorneys argued that this witness was not a creditory, because, according to them, in the previous review, he had remained in court until he gave evidence.

However, according to the court's chairman, Violet Huja-Rugova, this objection from defenders is uninstructed for the fact that the witness after the change of the new court has never been heard in the quality of the witness, whereas whether he is a creditor or not, it is up to the court to assess.

Witness Rame Ramaj has stated that the day before the murder, defendant Durim Lusaj had gone home and had told him why he had given the police his house cameras.

He added that police had taken the cameras into his house to see who was the person who had broken Dervis Lusaj's car, while on these cameras, according to the witness, had now been accused by Sali Lusaj.

He has declared that, for the delivery of cameras, defendant Durim Lusaj had told him they had “that he saw the argument”.

As for the critical event, witness Rame Ramaj has said he has seen two indictees Durim and Sali Lusaj now killing the late Burim Ramaj.

However, the defender of the accused Durim Lusaj, lawyer Salih Macay, has said that this witness had never mentioned the past considerations that he had seen the two accused now killing the late Burim Ramaj.

According to him, the witness had only stated that the two accused had been captured near the deceased, but had not said they were killing him.

I don't know why it's so consistent and I didn't say so. I have said even then that the two defendants killed the late Burim”, Ramaj witness said.

While defendants Sali and Durim Lusaj have reacted by commenting on witness statements, according to them the witness had not been on the scene.

Lawyer Kelmendi named this witness as non-Candid, especially with his statement, when, according to her, he said the two defendants shot the deceased Burim Ramaj with a gun to the back, while the latter had no wounds on the back.

The next session is scheduled for December 26, 2019, 10:00. For this murder, the Constitutional Court in Pec on April 14th of last year had convicted and sentenced the accused, Durim Lusaj, to a unique 25-year prison sentence for the criminal offence of heavy murder and illegal armsmen, and Sali Lushane, to a unique sentence of 18 years in prison because of the criminal offence of heavy murder in co-ordination and illegal weapons.

The Court of Appeals, on July 3rd of last year, has approved complaints by defenders of accused Durim Lusaj and Sali Lusaj as based, and has turned the case into restoration because of the essential violation of the criminal procedure and incomplete confirmation of the actual situation.

“The Court of Appeals has concluded that the act of first degree is involved in the substantial violation of criminal procedure provisions from Article 384 par.1 points 1.12 related to Article 370 par.6 and 7, which have also contributed to the full confirmation of the actual situation”, points out in Apel's decision.

According to Pec's Constitutional Prosecutor's Act, Durim Lusaj is charged on 25 August 2016, at around 18:30 in the village of Shaptej, the Decani municipality, following a preliminary dispute, has deprived life of Rexhep Ramaj with firearms.

The same, according to the indictment, having deprived Rexhep Ramaj of life, along with Sali Lushai, is also charged with killing Burim Ramaj, as well as with firearms.

According to the indictment, those with these actions have also endangered the lives of minor A.R. and Gani Ramaj and Mustaf Ramaj.

Both are accused by the prosecution of criminally committing serious murder and illegal possession.
