It started to take four of us, two boys and two kids, and now we're sitting in coffee, and those two chips have gone to the market to buy something, and we're stuck with the waiter to get our service, and the waiter has come to us in the first minute, and there's been a five seconds of silence that he's come to talk about, you know, and they're saying we're sorry to hear from you people in the LBT community, your community. Now there was a very strange situation between us and him that we didn't know what was going on, and our first reaction of both has “paramenno!” 'Cause it took a lot of us out there, you know, I'm really sorry that I didn't know based on what you're judging me, or anything else. First of all, I'm wearing really normal, and I'm totally dressed. We've never even done a scene, ever. I don't know, I know. I was yelling at him, and I told him you're the most terrible place in the world, nowhere in the world, never in life. I never saw anything like that, nowhere in the world. That waiter wanted to lower my voice that the bull had done other scenes and the story went out and we saw that boss, and he said, "I've never seen anything like it, and I never did well with things like that you've never had a job after me and I'm selling the art gallery, so I'm doing it at the local performance, so we're doing what we're doing with people who've been doing without prejudice to Kosovo.

Immediately after, an educational and cultural page on the social Facebook and Instagram network, called “Dylberism”, which aims to raise the awareness of citizens by offering news, historical and scientific facts, personalities, art, etc., and so on the LGBTI+ issues, has reacted to the case by presenting it as a case of discrimination.

Kosovo expects immediately after publishing comments on social networks where an online action against “Traff Gallery” has contacted the group to understand why they launched such a campaign.

In a written response to Kosova Prees, the group has shown that they had received information that during the past week, two boys who were not couples, however, have visited Traffifi Gallery Pristina's shop with the goal of drinking a coffee.

When they entered, a waiter approached you to say” but the boss told us not to let the LGBT community, and your community sit down. Two boys have reacted by confronting the waiter, but in the end they're not allowed to sit down. A friend of theirs wrote us on our site telling the event”, has shown Dylberism for KosovoPress.

This group says it has immediately begun with social actions to make the sound event, hoping to raise awareness about cases of “tilla discrimination and prevent the uneven treatment of the LGBTI+” community. The group is also hoping to reflect on the mistake and apologize for the action.

“We as a site thought to react immediately to this case of discrimination, where we asked our attendants if they were willing to co-operate about an online action on some homophobic. For very little time, over 100 people have offered to participate”, Dylberism for Kosova Preress has shown.

The group's invitation had been responded to by activists and citizens who started writing comments like “M Header” and “HOMOFOBA” in their profile, launching an online campaign against homophobic. Comments which, according to Dylberism, have begun to be erased by Traffiffi Gallery Pristina.

“Trade Gallery reacts by deleting post with over 500 comments as well as blocking comments in their account in the Instagram. The action then continued on Facebook, where they were written bad news on Traffy Gallery' profile, to list that place as a discriminater, homophobic and not sure. After that, instead of apologizing and reasoning, Traff Gallery made a meaningless post: “Traff Gallery is not a hotel room. Thank you for understanding.” Once the case has been delivered, many people have been reported to our site showing that the same thing happened to them, so they're not allowed to sit down with the reasoning that LGBT people aren't allowed to sit down, and that's based on their” appearance, the group tells Kosovo Press.

Edon Shilek says that of TrafiC Gallery could exclude any person who had problems at the locals, but not just because it belongs to one community or another.

Shilek: We haven't made any problems, we can't be expelled only if we belong to a community

I don't know. I'm getting a lot of stuff going on.

The Kosovo team Prees has visited the local “Traffic Gallery”, owned by Burim Berisha, who asked for an answer to the case. Berisha has refused to speak before the camera, yet in a written reply, he says it's a “that is bad sense”. And, according to him, it's about a tendency to hurt his locals, even though he didn't deny they left Edon with his friends.

We're only dealing with a misunderstanding and it's not even about the community in question, because “Traff” is already known as the gallery coffee open to all, and like “target“has artists and their supporters indiscriminately. In 2013, Parliament passed the bill on the creation of a working group for the LGBT community, while on May 17, 2014, politicians in the country, British Ambassador to Kosovo Ian Cliff, as well as local organisations for the LGBT community, QESH and CEL Kosovo organised the first march for the LGBT community in Pristina.

The first parade of pride in Kosovo is held in Pristina on October 10th 2017. Hundreds marched the streets of the city. President Hashim Thaci, as well as American and British Ambassador to Kosovo, participated in the event.

Despite good legislation, however, there is difficulty in implementing community rights. Stigma is still considered a point to work on. But even laws have a vacuumer in order to obtain transsexuals or to change gender identity. Organisations protecting the rights of the LGBTI+ community have announced that 4 September they will hold a calm rally in protest before the Constitutional Court, to ask the state institutions to respect the positive obligations of the state of Kosovo for protecting human rights by calling at Article 53 of the Constitution of Kosovo.

One of the institutions protecting human rights in Kosovo and addressing cases of discrimination is the ombudsman institution.

Edona Hajrullahu, the deputy occupants of the people who represent the department of discrimination in an interview for Kosovo Press, has explained that the legal framework for protecting the rights of this LGBTI+ community is very advanced.

And actually, in a legal way, I can say that the legal framework is quite advanced, that is, guarantees rights for all social categories, given the Constitution, which is based on the values of equality and non-decision of human rights, as well as a set of other laws which guarantee equal rights to all citizens in the Republic of Kosovo. The constitution for more envisions the priorities of international instruments in comparison to local legislation, if there is conflict between the provisions of local legislation, such as the Universal Declaration of Human Rights or even the European Convention for Human Rights and its protocols... And since 2015, we have a package of laws called For Human Rights, including the Law for the ombudsman institution itself, is the Law for Protection From Discrimination and the Law on Gender Equality. So other laws give power or are as guarantor for human rights in the Republic of Kosovo”, it has explained.

Hajrullahu also said that from the ombudsman's perspective, it should be stressed that the mandate of this institution comes in expression when a public authority of the Republic of Kosovo -- that is, public institutions violate a guaranteed right of an individual. Which means that if police fail to conduct proper investigations in the case of violations, then the ombudsman intervenes, pointing forward that in 2017 they have sent a legal opinion about homophobic and transphobin to the Constitutional Court.

This year the ombudsman's office is also engaged in the case of legal opinion about the Constitutional Court, which refers to gender identity and changing the name of the person - one gender into the other - the case of Blair Morina, but this case is still under preparation and will soon be forwarded to the Constitutional Court.

Regarding the case that took place in <x0raff Gallery”, Hajrullahu has not given an assessment of whether it is a discrimination, but has said that they did not accept any complaints but that the moment it becomes public they will react ex officio to the case in question and do the necessary investigations.

“We are not actually notified as an institution in question, usually the way we are informed of is or the party comes to the institution and directly complains to a possible violation, or if we are informed by other media in such a case, where there has been human rights violations. So we, in those cases, start with the investigation on the official duty of ex officio, we open it as the case and we see what the problem was, namely, what institutions have not done their job properly. . There are some approaches that can be followed, in concrete cases the side can be directed to us as an ombudsman institution and complain against the legal person in question. And we in that case conduct our own investigations to find out that actually not offering service is based on discrimination. Also the other approach is whether people go directly to the tribunal through ignorance, and expect that the decision the court can get back on the issue of discrimination”, Hajrullahu for Kosovo Press has explained.

The Office for Good Government in the Government of Kosovo has issued no declaration to Kosova Prees about what the Government is doing to advance the position of the LGBI+ community in Kosovo.

Halil Matoshi from the Bureau for Information has said through a short phone response that” “The government of the Republic of Kosovo does not specify ethnic and social groups, d.m. th guarantees freedom, constitutionality, and free access as a state to all its citizens indiscriminately, indiscriminately means having a comprehensive approach of”.
