The chief of the PDK Parliamentary Group, Memli Krasniqi, has refused to give up the second public position that holds it along with that of the MP, even though the Anti-Corruption Agency (AKK) had officially announced it constitutes a conflict of interest.
Krasniqi, in addition to being Kosovo's Parliament deputy, is also the vice president at the Kosovo Olympic Committee, writes Periscopi. But the position in the Committee, Krasniqi is maintaining despite the fact that the AKK had warned him that this constitutes violation of the Conflict Law on Interest.
In a decision by this Agency, dated August 15th, a copy of which Periscope has provided, this agency shows how its officials had sometimes met with Krasniqi to explain the case. They had asked him to withdraw from office in the Committee.
But the deputy from the PDK ranks, ahead of agency officials, had denied that maintaining these two positions is in conflict of interest.
“From senior official Mr. Memli Krasniqi has been asked to give up a post within the legal deadline, otherwise the Agency is obliged to comply with Law No.06/ L-011 for the Prevention of Conflict of Interest. After that, at the request of Mr. Some meetings have been organised to discuss the case. During these meetings, the senior official has not accepted the Agency's agreement on the conflict of interest situation”, said the Anti-Corruption Agency's decision.
In addition, despite the legal deadlines provided by the Agency, Krasniqi has not taken action to avoid the conflict situation of interest in exercising public office.
The Agency's Findings and Law In violation
In its decision, the Anti-Corruption Agency shows it has sent a warning letter to Krasniqi, with which it has been found that the exercise of office as MP and at the same time the first vice-president of the Kosovo Olympic Committee is contrary to the Law.
Exactly with Law No. 06/L-011 for the Prevention of Conflict of Interest in Public Function Army.
Article 14 of this law says that the top “office can be a member of the governing body, except for the leading function, of the nongovernmental organisation from the release of science, sports, education, culture, humanitarian activities and similar without the right to pay the bill, in addition to the compensation of travel spending and other related expenditures to”.
This turns out that, Mr. High Official. Memli Krasniqi may only be a member of the Steering Body at the Kosovo Olympic Committee, excluding the post currently exercised at the Executive Board as First Vice President”, the AKK claims.
AKK seeks action against Krasniqi
Because they do not give up this position, The AKK says it has announced it to Kosovo Parliament Speaker Kadri Veselin in order to take action against MP Krasniqi, as well as has announced that the case will soon end in court.
“Agentia will request the launch of the procedure for countering by competent court”, the verdict said.
The procedure is done at the initiative of Kosovo Assembly head, in this case Kadri Wessel.
“Based on Article 22, paragraph 10, of the Law (Nr.06/L-0111), when the Parliament's deputy exercises irreconcilable activity with this law, the agency announces the Speaker of the Parliament, and requires the start of legal procedures against him”, the AKK ruling says. /Periscopi/
