Nine months in prison against two accused of assaulting journalist Gazmend Morina

According to the trial pronounced by court judge Ferki Xhaferi, the accused and the other parties in this procedure, regarding this indictment, they have a fair complaint in the legal term, following the confession of the trial, reports the “Justice Vow bet”.

Judge Xhaferi, during the plea of the indictment, announced to the accused that prison sentences with their consent could be replaced by fines, but the two accused expressed no readiness to do so.

In declaring this act, there were indictees Dedia and Krasniqi, as well as the injured Gazmend Morina, while the case prosecutor, Jelena Marinovic, has not introduced.

Similarly, this Tuesday, the court review hearing has been held, where the final word by the parties has also been given in this procedure.

The prosecutor of the case, Jelena Marinovic, during the elaboration of the final word said she remains in all close to the alleged allegations in the indictment.

Marinovic added that he requires the court that, in the case of the pronunciation of type and the height of the sentence, take into account extenuating and burdensome circumstances under the law.

In addition to prosecutor Marinovic, the conviction court for accused Nedzat Dedia and Labinot Krasniqi has also demanded the injured in the case, Gazmend Morina.

The injured Morina, in his final address, said that, among other things, this attack was pre-organised, according to him, evidence of the circumstances that the attack was done right at the time he completed his work schedule and behind the object of the Wushtrrit municipality, where he worked and still works.

Morina, referring to accused Dedia, stated that one day before the attack, he was sought by the accused in the Vushtrri municipality and that after not meeting that day, he continued his search the next day when, according to him, the attack occurred.

Moreover, Morina said that all of this came as a result of the investigative writings, as he says, regarding mismanagements made in the “Trepca”, from that time the company's manager, Ahmet Tmava.

In the end, he injured Morina, said he wants the court to declare a merit case for accused Nexhat Dedia and Labinot Krasniqi and the same to be punished according to the law.

Meanwhile, accused Nexhat Dedia, in his final address, indicated that according to him, the attempt of the injured Morina, is to rise to position through various inventions and provocations.

The accused Dedia has indicated that he respects the Court despite the decision that will be made regarding the concrete case, because according to him, it is the first time found in the quality of the accused.

However, the other accused, Labinot Krasniqi, in his final address has said he feels sorry for all this has happened, because according to him it has all been an incident denying that all was planned, according to him, claims the injured Morina.

According to the accused Krasniqi, on that day along with the other indictees, Nexhat Dedia have been going to his bar, which he said lies behind the Vushtrri municipality object, after which, for the incident in question, he has sought forgiveness from the injured's relatives, Morina, who he said knows very well.

Otherwise, accused Nexhat Dedia and Labinot Krasniqi have been acquitted at the hearing of the trial held on August 9th 2018 at the Mitrovica Foundation Court, the branch in Vushtrri.

According to the Constitutional Prosecutor's Act in Mitrovica, accused Nexhat Dedia, on January 23, 2016, in Skopje, has thrilled the other person to find a bad one after publishing a photo on Facebook, together with the Nationalist Manager “Shrepca”, Ahmet Tmava and the other accused Labinot Krasniqi.

Based on the indictment, the event has taken place in the way that now injured Gazmend Morina, in the photo published by the accused Dedia, has written the comment “there is no further crisis for Trepca”, where after three hours, the defendant Dedia has threatened to hurt Morina, that she will see the fight when she returns to Kosovo, telling “to see who I am, you have a problem with this task.

With this, accused Nexhat Dedia was accused of committing criminal work “canos” by Article 185 KPRK's.

Following the indictment, it is said that accused Nedzad Dedia and Labinos Krasniqi, in co-ordination on January 26, 2016, have caused bodily injury to the injured Gazmend Morina, so that according to the indictment, by force they have opened the door of the car “Fiat Punto”, in which he was sitting injured, crepas have begun to attack him and beat him with metal bars, causing slight damage to the body, reddening of the left-hand side, left-hand flank, left-wing region, left-hand region, and temporary health consequences.

With that, they were accused of committing criminal work “slight bodily launch” by Article 188 over KPRK's Article 31.

Also, the accused were charged with criminal acts “with the annihilation or damage to property”, by Article 333 of the Republic of Kosovo's Criminal Code.
