According to the indictment compiled on March 16, 2018, by prosecutor Blerim Igrista, the lawyer Gashi on April 29, 2016, after having previously completed hearings at the Constitutional Court in Pristina, where in the process, the prosecutor had been informed by the court of the case that the hearing was closed and that it had to be preserved as privacy what was spoken there, the same with the hearing, without authorisation of the identity of the person protected in the criminal procedure by addressing the motion and citing his name in a public way.

This indictment, provided by the “Justice Vow” that has been exercised against Tome Gashi, is an indictment on the request for the pronunciation of the penal order.

Confrontation against Gashi, on May 10, 2016, was filed by the criminal judge at the EULEX Justices Mobile Unit Marie Tuma. In the letter provided by the “Justice Vocation”, which Judge Tuma had addressed to State Chief Alexander Lumez, she has filed criminal speculation against Gashi for criminal acts “violation of the secret of the procedure” and “contempt of court”.

But, on March 16, 2018, prosecutor Igrista had partially thrown down criminal charges for criminal work “contempt of court” because, according to him, there is no reasonable doubt that lawyer Gashi has committed this criminal act.

According to prosecutor Igrista, following the analysis of criminal cohesion and other attached paperwork, it is seen that the essential elements of the criminal act have not been met.

That, as it says in the indictment, the court has only informed the parties that the hearing is closed and that everything spoken there is confidential and does not make it out.

Otherwise, in her letter to Judge Tuma, the judge of the preliminary procedure had issued an arrest warrant for defendant Azem Syla on April 26, 2016, where police later arrested him on the same April 29, 2016, and had brought her before her as a custody judge for a hearing for custody.

Tome Gashi was representing the defendant. At the beginning of the detention hearing, I declared that the session was closed and that any information concerning the hearing was confidential and should not be revealed in the media or anyone else. All parties, including lawyer Tome Gashi, indicated they understood this and took upon themselves to respect it”, had written Tuma on the letter to Chief Prosecutor Lumezi.

Then, reportedly during the course of the session, the prosecutor EULEX had stated that its case was based on a number of sources of evidence, including the testimony of two co-operative witnesses and protected witnesses.

He claimed the main witness was N.B. He said EULEX judges had previously applied safeguard clauses for this witness in two other cases. On November 3, 2015, the judge of the preliminary procedure has also issued an order announcing the N.B. to be a brilliant witness in this case. I have continued the session, and on April 30th 2016, I have issued a warrant assigning defendants Azem Syla a month's detention”, reportedly to criminal proceedings by Judge Tuma.

However, she had now said that on May 2, 2016, she was informed that Tome Gashi allegedly made statements to various media in which he identified the N.B. witness. and has stated that the prosecutor's case was based on his testimony.

She has said that Gashi appears to have given those media statements shortly after the April 29th 2016 session.

It looks like Mr. Gashi just ignored my instructions. I'm aware of previous cases, as I'm sure as you are, that N.B. witness. Despite his status as a protected witness, he was scared and even tried to hurt him”, he wrote Tuma on criminal row.

Regarding the establishment of this indictment, the “Justice Trust” has contacted lawyer Tome Gashi.

He has said he is unaware that such an indictment has been filed against him, so he has said that in this regard he will be declared after it is announced to him. /BpD/.
