No one in Kosovo knows about the fate of six Turkish citizens, who were arrested and later deported to Turkey. They were arrested in March this year to appear before the Istanbul Court in the following month.
Cihan ãozkan, Kahraman Demirez, Hasan Hüseyin Günakan, Mustafa Erdem, Osman Karakaya and Jusuf Karabina have surrendered after completing their procedures at the Antiterror Department near Istanbul Police and undergoing medical checkups. This is the last information they know about their families and lawyers. Kosovo institutions also say they do not know anything about those who had initially given permission to stay, and later in one day had revoted them, arrested and handed them over to Turkish authorities.
Time. We have contacted Leutrim Syla, Cihan ãozkan's lawyer, who later committed himself to other deportants. He says they received no more information from anyone about their condition. Syla, has said that some of their family members are already not feeling secure in Kosovo, and have started asylum procedures in other countries.
Some of the family members are in Pristina, in private residences, and there are those who have gone abroad and applied for asylum status. At the moment, their families are well in health but in fear and state of uncertainty”, he said.
Deported family members have not been notified by Turkish bodies of their family situation, says Syla. He indicated there is only information that six Turkish citizens are now in custody.
“As a lawyer I have not been able to get more information except that a session has been held and that all six Turkish citizens are currently in custody”, he said.
We remember that among them, there is also a Turkish national who was wrongly deported.
When Kosovo police were ordered to arrest Turkish national Hasan Hüseyin Demir, instead had arrested another Turkish citizen, Hasan Hüseyin Günakan.
Last week, the new AKI director, Shpend Maxhun, for the first time after taking office, reported before the Parliamentary Commission on AKI Supervisor. When the topic of deportation of six Turkish citizens opened, nothing new was reported about them.
Time.net has also tried to receive answers from the Ministry of Internal Affairs and the Department of Asylum and Migration in Kosovo, but they have said they have access to information about their current situation.
“Regarding your questions we don't have any information for citizens in question”, the MPB response says.
Koha.net has also tried to receive answers from the Kosovo Embassy in Turkey, but now four days they have not returned to the portal's interest.
The so-called situation about not having any information from AKI and MPB about the state of invasive, lawyer Syla considers it an additional test to prove that it had nothing to do with deportation, but with an extradition in the form of illegal surrender by avoiding legal procedures, so, he says, this surrender does not fail just as Ugur Toksoy's extradition had failed.
Where even the State Attorney had withdrawn from his request for extradition in absence of evidence. Thus, the lack of any information from state bodies confirms what has already been claimed as a vasality of our state to the Republic of Turkey. I support this in the fact that the deportation of the six has been carried out in an informative darkness, with vague revocation of the permits, with an expulsion where the order has been issued to them - not an expulsion order that should be issued in the case of the expulsion of this type”, Syla said.
He also added that the deportation has been completely illegal, proving that in Turkey, the person with two citizenships has also been deported, from which one Albanian. The application for residence permits is also being made with Albania's documents, so the expulsion would also have to be made in Albania, not Turkey”, the Coha.net lawyer said.
The other lawyer, Urim Vokshi, has earlier said that members of the deportees have only filed a complaint about the order to leave with force, but has indicated that family members still here are preparing files for this case to go to the Constitutional Court.
Lawyer Syla said that if this case is not dawned, and thus responsible persons are brought to justice, and not left with certain resignation requests, “could occur even more serious cases in the sense of ignoring and violating guaranteed rights with the legislation in force”.
