They left for Serbia on Sunday. In the evening one of them was arrested while the other was forced to return to Kosovo.
Fahri Jusuf from Mitrovica since Sunday is in custody in a Kralev prison, while Necmedin Jusuf has returned.
He exclusively relates to Kosova Prees how the arrest of his fellow Fahri Yusuf had taken place, who also has a close cousin.
Nedmedini, who was driving the truck he was traveling with Fahriu, relates when Serbia's police stopped him as they entered their territory.
He has sufficed a control of Fahri's ID by Serbian police officers and has immediately become his arrest.
While family members have not received any official announcement from Serbia's competent bodies, they have alleged that arresting their relatives, Fahri Jusuf, could be made based on an injury that occurred in 1988.
According to family injuries occurred in Kosovo.
The Yusuf family does not have much information about the fate of their relatives, although one of his brothers has travelled to Serbia.
I gave my and his ID at the border, because there are some certificates that should be issued instead of patenting the driver because he doesn't want to see our license from Kosovo drivers. Even when he put his ID on the computer, something came up. I was surprised, I said this couldn't be asked. And I guarantee, I mean, he didn't do anything. I didn't want to discuss that... They decided to arrest him. They took him out of the truck. They left him in that office. I contacted him a little bit, asked him if you did something. He said, "You know, I didn't do anything. So at that time I wanted to go on the road because they told me you had no business anymore and that this should go to Kralev. I said, "Well, is there any information I can get back to?" They told me he's got the phone and he can contact his family, I said no, I'm interested I'm going under stress. They refused to discuss that matter. They said we called somebody, but they haven't called in two days. It means from Sunday at 19 to today, I don't have any information for him, said Yusuf.
Necmeddin Jusuf once and the cousin of the detainees indicated that Fahri Jusuf had never been to Serbia.
He expresses concern for him in Serbia, until he says all of this could be an assembly. He appeals that the Kosovo government will also be engaged in this case.
I appeal to our government not to torture citizens. This is where our government was supposed to be, at the moment that this interventu was found, ask me why that man stopped, let's know what he's got. There's something, prison, but not in this way, not”, he said.
Lawyer Azem Vlass, who has said that all cases that have been in court procedures for the actions of Kosovo citizens who have been carried out in Kosovo, are competent.
According to him, following an agreement between the UNMIK administration and Serbia's Ministry of Justice, all the accused and prisoners who have been in Serbia have returned to Kosovo, where those who had criminal acts have served the sentence while those who were politically imprisoned have been released.
So why is it before that agreement with UNIMIC, which was made in 99, whatever the case is in the hands of the Kosovo Courts and not Serbia's... But this is evidence that Serbia does not accept Kosovo as a state and does not even accept Kosovo's” judicial power, Vlasi stressed.
The lawyer says that on this topic of its own, Serbia extends the competencies of its judiciary to Kosovo citizens as well.
As for allegations that the former LDK candidate for Mitrovica Asamblis has been arrested for a 1988 criminal offence, Vlases says that for acts that have passed the prescription time, no one has the right to prosecute them, and much less stop people.
If it's about work that's getting older, then no matter why we have no agreement with Serbia or anyone in question, there is absolutely no right to either the Kosovo judicial system or Serbia's. Because it is a universal matter for cases according to the law. That standard of aging works is of Kosovo, Serbia's criminal law and all states. Then especially in these cases, there is no one right to be banned, nor to proceed or eventually suffer a previous expulsion if the age of aging has passed or, as we say, the lawyers of prescription”, he said.
Fahri Jusuf's arrest in Serbia has also engaged the Kosovo Ministry of Foreign Affairs. MPJs have said they are tracking this case and will then take all necessary measures and actions. MPJ announced that Fahri Jusuf has had an arrest warrant issued by Serbia
The MPJ's Communication Office has confirmed it is aware that the Kosovo citizen is on hold in Kraleva on the basis of an earlier halt.
“The Ministry of Foreign Affairs through the Interconnecting Office of the Republic of Kosovo in Serbia confirms the ban on a Kosovo citizen with the 24 June, at the border checkpoint in Rudnica”, have declared by the Communication Office in the MPJ.
According to the MPJ, through the Liaison Office in Serbia it is closely conveying this case until they say all respective measures and actions will be undertaken.
The Serbian state continues to arrest Kosovo citizens, even on charges older than 20 years. In addition to charges against former KLA participants, Serbia has filed charges on other acts dating back to the pre-war era.
Fahri Jusuf is a member of LDK. In the recent municipal elections, Jusuf had competed for the Mitrovica municipality's Asamblis.
