Women in Kosovo, legal battle over 10 years to inherit home

Shyhrete Berisha and Shukree Berisha are two of the cases where the court procedure for the right to exploit the house where they lived with their husbands has extended over a decade.
Shukrie Berisha has been demanding the right to exploit half of the house where he lived with his husband for 13 years. She has launched a legal battle with her brother-in-law.
Shukrie and Zeqir Berisha were together between 1986 and 2003 when Zeqiri passed away. In addition to the pain of losing her husband, Shukries soon had to face another problem - she was in danger of losing a roof over her head.

In contrast, Shyhrete Berisha, in her legal battle with her brother - in - law, proved victorious.
Shyhrete Berisha has survived the massacre against the Berisha family on March 26th 1999 in Suhareka, in which her husband and four children were killed, the youngest of which had been less than two years, while she herself was wounded.
However, after the war, in 2001 she launched a court battle with her brother-in-law, Jelal Berisha, who took her home in which Shyretta had lived with her family until the day of the massacre.
In July 2017, the Basic Court in Prizren, the Suhareka branch, has decided to recognise the right to Spartate Berisha's ownership on the basis of legal heritage, according to representation after the death of her husband and children.
Against that decision, the dissatisfied side had filed complaints at the Court of Appeals.
But, although over a decade has passed, the trial for Sculvey and Shyhrete Berisha has not yet made a decision on the formal form.
Shukrie Berisha's lawyer, Albana Kelmendi, has said of callos.com, that such delays only hurt her client even more.
“Taking on the basis that 13 years have passed since Schcrite Berisha has been demanding her right to the instability where she lived with her late husband, Berisha has only been denied enough of her right. Such delays to the full extent of the decision are very harmful to the party, but, in the case of making the decision, I hope that the second rate will make the right decision by deciding in favour of my client, so approval of my entire” complaint, Kelmendi said.
The portal has asked the Court of Appeals to know where these subjects are at.
In response to the report by Judge Arber Jashari, Shukre Berisha's case has been accepted at the Court of Appeals on September 20, 2016, while Shyhrete Berisha's case has been accepted on November 6, 2017.
According to Jashar, both cases have been handed over to judges and are in line for deployment.
He has reasoned with the large number of subjects facing this court.
“The Court of Appeals is facing an extremely large array of subjects in civilian soil. So it is impossible to place matter within a short period of”, Jashar said.
At a media conference by the president of the Court of Appeals, Hasan Shala, held in December 2017, he has indicated that over 12,600 unresolved subjects remain.
Mayor Shala has said the reason these materials remain is because a total of 11,266 matter was inherited in 2016. /Call. com
