The EULEX request for his arrest was made by the Kralev Foundation Court in Serbia. In a response to Radio Free Europe, the EULEX mission has said it was impossible to take such an action because of its mandate.
“The EULEX mission has received a letter from the chairman of the Foundation Court in Kraleva seeking assistance in executing the final decision. The mission has no competencies to proceed with the request under the current mandate. This fact has already been communicated to by a letter to the Constitutional Court (Kravalev), says EULEX's response.
Radomir Laban was nominated by the political subject, the Serbian List to be the Constitutional Court judge until Kosovo Assembly deputies approved his election to this position.
Kosovo's president has two weeks to approve such a decision.
Laban has been sentenced by Serbian authorities to six years in prison under charges of bribery.
It is believed that in recent years he has remained in Kosovo, fleeing the authorities of Serbia.
The Vetevendosje movement has asked the president, Hashim Thaci, not to decree Radomir Laban in the judge's position.
The Council for Protection of Human Rights and Freedoms has made such a request, demanding a verification of its past.
