“Server at the ministry was infected because workers were watching pornography” The testimony on trial for MTI

According to him, among the services this company had performed outside this project was the reinstalling of the Ministry's server, which, as he said, has been infected with viruses from viewing pornographic Web sites.
Regarding the implementation of the “City Navigator” project, they are now charged with misuse of the official position, two former MTI officials, Halili Bajrami, as former policy leaders and tourist promotions, as well as Burim Zekaj, as manager of the Procuration Office in the ministry.
They are accused of enabling the company “Atak Consulting”, the project's total payment, without contract commitments being met.
Witness Salih, at Tuesday's session at the Constitutional Court in Pristina, in the trial of this case, has stated that additional jobs have cost this company much, especially the reinstallment of the MTI server.
We have given up a lot of material for the project that wasn't part of the contract. Our worker worked at MTI's offices for about a month to meet MTI's additional demands, which have been out of contract. The cabins where the kiosks were placed have been placed twice that there was no co-ordination within the MTI. We've never been paid for these services. The server, which was located at the MTI, at the guard's office, was infected with pornography viruses, examining pornography, costing us a lot to reinstall the” server, the witness said.
Responding to accused Burim Zekaj's questions, the witness has stated that he does not remember ever met, or that he has accepted any e-mail from him, in the quality of the head of the Procuration Office, at the time the project was under way.
As for the contract for the “CityNavigator” project, the witness has stated that, according to it, the installation part has belonged to the company to operate a vehicle, while infrastructure, internet and current under the contract were the responsibility of the MTI.
Regarding the number of navigationists that have been deployed, the witness said he does not remember, but, according to him, the same are placed on all points the MTI has secured their deployment. And their appointment, according to him, was not mentioned in the contract, nor was it the company's responsibility.
Salihu stated that the deployment of the equipment has done it more than once, on voluntary basis, in order for the project to work.
The Witness has said further that there have been promises from MTI that these expenses will be covered later, but he added that he cannot remember who is promised such a thing.
Under the contract, the payments were meant to be carried out in two installments of the total value of the contract, 20% paid in advance form and 80% after the contract was completed, where, according to the witness for these payments, bills were issued by respecting the terms of the contract.
He has denied that his company has been paid without meeting obligations from the contract.
Asked by accused Zekiaj, however, whether they have ever been announced during this period by the Contract Authority that they will be penalised for any unpronounced duty, the witness said he received many threats from the Contracatory Authority, which, according to him, was responded by e-mail.
Asked by Zekaj whether they submitted two guarantees to the Accounting Authority for a guarantee of the advance and a guarantee of meeting the contract, the witness said that with his knowledge, he knew there were guarantees, but I don't know if there were two.
In this session, his testimony has also been given by Adem Krasniqi, since 2009, has held the position of head of the MTI Procurement Department.
Krasniqi, has stated that from his experience and procurement practices, in cases when the delivery of equipment is done according to contract and the same are not accepted by the accession commission, it is not allowed to have the equipment returned to the economic operator unless they are damaged.
The witness said he cannot remember that during the time he held such a position, any interpretation of the project contract “City Navator” has been requested.
For this project, the witness said he was not invited to meetings where the economic operator and MTI officials were participating.
As for the contract guarantee for the project in question, the witness said he cannot remember whether there was one, but according to him, each contract should have guarantees of fulfillment.
Regarding the seizure of the guarantee, the witness has stated that the Accounting Authority has the right to secure the guarantee in case the contract has not been met and such recommendation, according to him, gives the organising body or the draft manager.
In addition, Krasniqi has stated that in cases where there is no manager's draft, monitoring contract implementation makes the person who signed the contract.
Otherwise, the court has made a decision during this hearing to approve Prosecutor Feti Tunuzliu's proposal that Bujar Red's testimony, Blerta Hoti and Najazi Shala, be considered read.
Such a proposal was made at the session held on March 26th, after witnesses had given their testimony to the court, which former Judge Faik Hoxha had led, but after Hoxha had resigned from the judge's position, this subject has already been divided to Judge Becir Kaluldra and thus the court review should be launched again. However, the proposal had been rejected after the defender of accused Burim Zekaj, lawyer Naser Peci, refused.
“The chairman of the court takes the decision to refuse the prosecutor's proposal to read witness evidence, and the court will try again to invite witnesses, Bujar Bari, Armen Salihi, Adem Krasniqi, Blerta Hoti and Nyazi Shala 116x1>, had been the verdict of Judge Kaluddra>.
However, after three other witnesses -- except for Amend Salih of Adem Krasniqi -- have not appeared in court, the court has made a decision to consider the statements they have issued before the court with different content.
During the 26 March session, Zekiaj's defender, lawyer Naser Peci, had proposed that another financial expertise be established, considering financial expert Shaip Bytyqi's expertise irregular.
However, this proposal has been rejected by the court at Tuesday's session.
The next session in this case is expected to be held on May 3rd, beginning at 9:00.
According to the indictment, Halil Bajrami, in the quality of the policy leaders and tourist promotion at the Ministry of Trade and Industry (MTI), has failed to fulfill the official task as host of the “city navigator” project. The prosecution claims he had granted the company “Atatq Consulting” from Gjilani the total payment in many of the 113,013.00 euros, payment from the “Funding, installation and maintenance of the city's navatory equipment”, dated October 1, 2008.
Always according to the indictment, although this company had only partially fulfilled the obligation to supply the MTI, with the pre-communal equipment which was worth much of 94,410,00 euros, the same has acknowledged advance in many of the 22.602.60 euros, much at MTI's expense.
Defendant Burim Zekaj, according to the prosecution, in the quality of the MTI procurement manager, failing to meet his official duties, on December 19th 2008, has issued payment warrants worth 90.410.00 euros for the company “Ataterq Consulting” in Gjilan. /Justice Trust.
