(8 years ago)31 top public officials have refused to declare their property in the Anti-Corruption Agency. Among them are prosecutors, judges, deputies and even municipal officials. The list of senior public officials has included 4737, of whom 4651 officials have declared property (98.18 %).
“Since the total number of those who have been forced to declare property, 49 senior public officials have declared property after deadline, 6 have not declared wealth with reason, while 31 of them have not declared their property so far”, the AKK report said.
And so, The AKK reports that 12 top public officials have not handed in property declaration forms during the regular annual deadline, because the same have declared property in December 2017 with the taking office in the member's post in the respective Municipal Assembly. It has been included in the list of senior officials, but it has not been exercising its post since 2013. Disregarding property or hiding property by state officials remains a criminal offence. This is about the fact that the government has given in to pressure from civil society and other representatives not to change the Criminal Code, exactly the point of declaring property. Otherwise, the wealth declaration process lasts a month. It has started on March 1st and ends today on April 3rd, as according to an announcement issued by the AKK the reckoning of this deadline is being made in accordance with Law No. 05L-031 for General Administration Procedure.
Article 81, paragraph 4 stipulates that the “Saturdays, Sundays and days of official holidays will not prevent the start and movement of deadlines. When the last day of a deadline falls on Saturday, Sunday, or an official holiday, the deadline expires on the day of work that immediately follows it”. Last year The AKK has filed criminal charges against persons who have not declared property. According to the AKK, no false declaration or statement of property by senior public officials constitutes criminal acts that are sanctioned by the Penal Code's provisions.
