Prosecutor, attorneys warn complaints against plea to police murder Shemsy Gashi

The Constitutional Court in Pristina on Monday, February 26, 2018, has declared the indictment, where it has pronounced a total of 58 years in prison against those accused of the murder of police Sesum Gashi, which had occurred in March 2015 in Pristina's “Matti 11<x1).

Disgusted with the court's act of first degree, the prosecutor and defence attorneys have warned complaints at the second-degree court.

“Ankee will do as soon as I accept the sentence in written form”, prosecutor Armen Hamiti has told “Even lawyer Bajram Tmava, defender of accused Ramadan Gashi, lawyer Behar Ejupi, defender of the accused, Kujtim Beqiri, lawyer Florije Drevija, defender of Adonis Gashi, lawyer Ramiz Krasnqi, a defender of Robert Gashi, have all warned complaints once they accept the written bias.

The indictment against the conviction in connection with the sentence has warned lawyer Mejid Syla, defender of accused Muja Gashi, and lawyer Mentor Neziri, defender of accused Vesel Bunnjak.

The complaint only to the height of the sentence has warned attorney Skender Musa, defender of accused Vesel Djindovci, who has pleaded guilty to the murder since the beginning.

The lawyer Musa for “Justice Vow” has stated that the court has been able to protect it, condemn it less based on the circumstances and co-operation of its defender, with justice organs.

“We consider that the court has taken into consideration and appreciated the fact that my co-operation and protection with investigators and prosecutors, but on the basis of international practices when a perpetrators of a criminal offence co-operates and discovers criminal work as a whole and the perpetrators of criminal acts are still lower, we as defenders will only file complaints in terms of criminal sanctions because we consider there has been room for the punishment to still be lower”, the lawyer said.

For pushing the killing, the first-degree court on Monday, February 26th 2018, has convicted accused Ramadan Gashi of being sentenced to 25 years in prison, while for illegal weapons, he has been sentenced to 1 year in prison.

Against him, the unique sentence of 25 years in prison has been pronounced. Indictee Vesel Djindovci, for criminal activity “serious murder”, has been sentenced to 9 years in prison, while 1 year in prison has been convicted of illegal weapons possession.

While the court against him has pronounced the unique nine-year release sentence. Indictee Metom Bekiqi has been sentenced to six years in prison for a criminal offence in carrying out the criminal offence of the serious murder.

The court has also sentenced accused Vesel Bulnjak to prison for 7 years, while for illegal weapons, he has been sentenced to jail for one year. The twin by the court has been sentenced to a unique sentence of 7 years and 6 months in prison. For the criminal act of assisting in carrying out the crime of murder by the court to four years in prison, the accused Adonis Gashi has also been sentenced.

The court for the accused, Robert Gashi, has re-qualified the panel work, where providing assistance as it was charged, in the absence of criminal offence and perpetrators, where it has been sentenced to 3 years in prison.

Agron Gashi, and Muja Gashi, from the court have been acquitted of a criminal offence in serious murder, since, according to the court, the prosecution has failed to prove that the accused are guilty. The court has made a special decision to continue detention of Ramadan Gashi, Vesel Djindovci and Kujtim Beic, until the full might of the act.

In the final address in this case, prosecutor Armend Hamiti had stated that accused Vesel Djindovci and Kujim Bekir are charged with criminally committing serious murder in co-ordination. Hamiti, had declared that the prosecution now for assisting in committing the murder, accused Vesel Bunjak, Adonis Gashi and Robert Gashi.

While, according to him, for pushing the killing, Ramadan Gashi, Muja Gashi and Agron Gashi are charged. The prosecutor at the court had stated that the motive for this murder had been property disputes between two families.

Otherwise, at the December 18th session last year, it was pre-emptive to declare the case, but the court had decided to reopen the trial.

The reasons for the reopening of this judgment, according to the court-led by Judge Valbona Selimaj, were that in the final address of accused Vesel Djindovci, who had pleaded guilty since the investigative phase, several elements have been mentioned that, according to her, had to be clarified.

The prosecution had filed charges against eight people in 2015, most of them family members of the late Shemsy Gashi, over his murder.

Vesel Djindovci and Kujtim Beki were accused of criminally committing grave murder in co-ordination.

Djindov had pleaded guilty to the initial examination and had apologized to the deceased's family, while early February of this year, the court had decided to revote the plea decision, where it was also permitted to provide protection to the accused before the court.

According to the prosecution, the reason why it had led to this murder was a property problem between the deceased and Ramadan, Muja and Agron Gashi, specifically for a parcel, property of 40 gold, at “Hospital sector”, in Pristina. According to the prosecution, Ramadan Gashi, Muje Gashi, Agron Gashi, Adonis Gashi, Robert Gashi and Vesel Bnjaku had gone to Brezovica, where they had planned to kill Sergeant Gashi.

Always under the indictment, Vesel Djindjic had announced Ramadan Gashi that after talking to Adonis Gashi, he has agreed to carry out the murder, while Ramadani had promised him a 5,000-euro reward, while with his vehicle Djindov sent him to the neighborhood school “Mati”, showing him the work schedule of Shemsi Gashi and the way he traveled.
