Prosecutor Wants Higher Sentence for Vetevendosje activists

The prosecution's complaint begins with dissatisfaction with the sentence pronounced for Adean, the two-year sentence, until it ends with his proposal that the accused be sentenced to higher prison terms.
The prosecution in complaint has estimated that on the occasion of pronouncing conviction for the accused, the Court has violated criminal law, with the argument that the two-year sentence for that criminal offence is a sentence under the first legal limit, until, for such a deed, the minimum sentence would be five years in prison.
According to the prosecution, there has been no extenuating circumstance for Adea Batusha, which will reason the sentence below the minimum legal limit, since Adea has neither pleaded guilty nor entered into plea agreement.
The prosecution in the complaint claims that even the sentences of others do not respond to the degree of social risk of committing criminal acts.
“Based in the fact that in this case we are dealing with a rocket launcher of a state institution which cannot be compared to any other institution, because it is the object of the highest legislative body of the state of Kosovo, and only the fate that the missile did not penetrate within the object has saved this object from being burned overall and not having consequences to people” is further said in complaint.
At the end of the complaint, the prosecution has proposed that the act of first degree be changed so that the accused will be sentenced to higher prison terms.
KA LLXO.com has also secured the complaint of Father and Arifi's lawyer, who was sentenced to six years in prison.
Arifi's lawyer, Ramiz Krasniqi, claims the act of first degree is illegal, without relying on any evidence, “in addition to the free and unattended conviction of Judge”, he has said in complaint.

In October 2016, they were convicted of the charge for which they were charged and sentenced to a total of 21 years and 6 months in prison.
At and Arifi has been sentenced to six years in prison, Frasher Krasniqi to eight years, Egzon Haliti to 5 and a half years, while Adea Batusha to 2 years in prison.

In this case, accused of attacking by explosive means against the Kosovo Parliament building were At and Arifi, Egzon Haliti, Adea Batusha and Frasher Krasniqi.
The four indictees of this case had been declared innocent at the session, held on February 28th this year, while the indictment had called it political, while their requests for dropping the indictment and breaking the procedure were rejected by the Constitutional Court.
Part of the indictment has been Astrit Dehari, who was found dead in his cell in Prizren in November 2016.
