One of the biggest cases currently being tried in our justice system is the case of the relationship “Proto”.
The Act, known as Pronto, was established by the Special Prosecutor of Kosovo in April of this year.
Eleven people with senior official positions, including a minister, former deputies, deputy ministers and former secretary general, are charged in this criminal case.
But who is the judge who will judge justice in the case of the relationship “Proto”?
He is Shashivar Hoti, judge at the Department of Criminals at the Foundation Court in Pristina since 2016.
Before that, he worked as an administrator at the Lipjan Municipal Court.
After accepting the indictment of the relative “Proto” by the Kosovo Special Prosecutor, Judge Hoti had decided that there was a case of the t dealt with the General Criminal Department.
This ruling had not been hired by Special Prosecutor Drita Hajdari, and to reject this ruling by complaint was addressed to the Court of Appeals.
In the prosecution's complaint, the Court of Appeals decided to return the subject to the Randa Crime Department to the same judge.
Thereafter, the judge had kept the prosecution's initial examination, refusing to read the indictment to the public at the request of defence lawyers even against the prosecutor's insistence that the indictment be read, an unusual judicial practice.
During his career as a war crimes judge, Shashivar Hoti has shared justice in some high profile cases.
Among these is the case of former Court of Appeals Chairman Sali McAw, where Judge Hoti had decided to conduct the trial by closed doors to the public.
Salih McAw had been acquitted this year of misusing the task, while during the proclamation of judgment, the judge had not reasoned anything about the decision before the public.
Hoti had also shared justice in the case of Bajram Pajazit, the brother of hero Zahir Pajaziti, who was accused of misuse of office, and this case had ended with a legal act.
The act of misuse of office against Murat Meshe, Ismet Kryeziu and Nemanja Spasic had been rejected by the judge's decision, which was confirmed by the Court of Appeals.
Enver Hasani had been sentenced by this judge to 1 year in prison, such a decision would not be executed unless the former reactor committed any other criminal act within two years.
His decision in the case of the former sector was changed by the Court of Appeals after it declared him innocent following the investigation of complaints -- innocence, which the Supreme Court later confirmed.
Except for these Shashivar Hoti, Sami Lushtaku's trial of escape from the KKUK, a case that's not been solved for a long time, where even the prosecutor EULEX, Romulo Matthews, was considered insulting to justice the postponements of this judicial process.
The history of the relationship
In April of this year, the Special Prosecutor of the Republic of Kosovo filed an indictment in the case called “Proto”.
The Special Prosecutor's investigations began in 2016, after Portal Insederı published some telephone wiretapping where senior Kosovo Democratic Party officials are heard negotiating employment on board agencies.
In this criminal case, eleven people with top official positions are charged: former US Vice President Ademi Grabovci, current minister Besim Beqaj, current deputy Zenun Pajaziti, two former secretary general, Ilham Gashi and Xhavit Dajaj, former Deputy Prime Minister Fatmir Shurdaj, political adviser to MPB Sadat Gashi, former director of the public company's board “Randoniqi-Dukani <X1> in Gjakova Isaj, former director of the public company <2Hdrot> at Abzhsi>, former Prime Minister of the former Parliament and Minister for Defence Equikafia in Pajni, Apojazijani, former Minister for the former Parliament.
According to the Special Prosecutor, the accused are charged with carrying out the criminal act -- the violation of equal status of the citizens and residents of the Republic of Kosovo in co-ordination -- by Article 193 paragraph 4 concerning KPRK paragraph 1 -- regarding Article 31 of which some of the works have remained on the attempt.
According to the indictment, defendants have misused their official positions by co-operating among themselves in granting privileges and priorities illegally to those who have competed in important positions, such as directors for central public enterprises, chief executive head of the Internal Affairs Agency, head of the Agency for Medical Products, and co-ordinator of the Civil Record Centre in the Cline, denying and restricting the freedoms and rights of other candidates, guaranteed by law.
Currently Justice Hoti, except the relative “PRONTO”, is also judging the cases of Enver Sekerrakes and MP Naser Osmani.
