Antonio Cte was dismissed from the post of Chelsea coach during the summer, following poor relations with club owner Roman Abramovich.
Cote has rejected the Chelsea proposal that the case be closed between the two sides and wants everything to go through trial.
The Italian coach calls for 26m euros' compensation, which would cover his 10.4m-euro salary in the season and another 15.6m euros in moral damage to the club, firing him.
However, they are convinced that they can win the court battle, claiming that Contes' behaviour by selling Diego Costan, the delays in media conferences, as well as his presence on events related to club sponsors, have forced the club to fire him.
