Constitutional Court Required to Restore Subjects for Repaying War Injury

The non-governmental organisation “Zerit” filed today 10 files to the Kosovo Constitutional Court regarding the refusal of indictments for compensation of war damages.
Representatives of this NGO, with the motto “Justice for the victims in the 2020 Justice Agency, have called for the unblocking priority of limiting the local judiciary to review indictments for compensation damage already imposed for 10 years.
Jahir Bata, chairman of the NGO “The raising of Voice”, has said local courts have unjustly rejected indictments for compensation of moral and material damage, and for this reason as a subject will not stop convinced they are on the right side.
The next “request for the Constitutional Court is to approve indictments for assessing constitutionality and Supreme Court decisions, cancel all decisions of the Courts of Appeals and Constitutional Courts, and the subjects to reprocedour courts to review and assess legal and international provisions. So in this case, we have a precedent. We're asking the 2020 Justice Agency to put the MD together with the leader on the throne as priority cases to unblock local courts by reaching an agreement that is a barrier, so to retain jurisdiction here. The victims waited long, for 20 years”, Bata said.
And according to him, the company of decisions mentioned above represents constitutional duty under Article 21.2, 22.53 and Article 54.
While attorney Kadri Osey indicated that during history, there are cases when in law bodies in various states the indictments are foreign states and have resulted in all-powerful decisions. While praising that what is happening in Kosovo courts is absurd.
“This is happening in our courts is absurdity, contempt of justice, placing politics in establishing court cases”, Osaj said.
The “Association's establishment of Voice” in July of this year has submitted similar files, but according to the president of this association have received no response so far.
