The chronology of the conflict between the two learned families in Kosovo, Elshani-e Kelmendi, has been proposed by EULEX prosecutor Adrew Hughes, to be administered as evidence in the trial of Granit Elshani, who is accused of committing six criminal acts.
This proposal was submitted to the Court on November 29, 2017, said the chairman of the court, Sami Shardaku.
But this offer has been opposed by the defense of Granit Elshan.
Lawyer Ndek Dodaj said that in the letter issued by the prosecutor does not meet even the basic conditions to proceed as evidence.
We're only dealing here with the data about the event and who's the victim. We don't have any indication of who's chief of”, Granit Elshan's lawyer said.
Lawyer Dodaj said that out of 24 cases of murders between these two families, only in two of them have procedures been developed, while in most cases he said there was no beginning of the investigation.
So from 2000 until 2014, when it was the last case, there were 24 cases. Except for the case of 2000 where the defendant himself was injured, as well as the 2006 case, where the victim was Jakup Osmani, procedures have been conducted, investigations have been conducted. I'm not sure how it turned out, but in the 2006 case, I'm aware it's over with a free trial. Of these 24 cases I don't see any involvement of this defendant in any case”, he said.
The information proposed by the prosecutor, according to lawyer Dodaj, is neither worthy of the credibility of criminal fraud, less of the evidence.
He also stressed that from these proposed information, he has seen no joint evidence of what Granit Elshani is charged with.
In one case, lawyer Dodaj said this is a professional provocation from the prosecutor for the level of judicial education and defence.
I consider this proposal a professional provocation, in a way to test the level of judicial and defence education, so I demand that this proposal be dropped”, Dodaj said.
On the other hand, EULEX prosecutor Adrew Hughes said he is demanding that the chronology of this case be part of the subject paperwork.
The trial and defence are aware that in murder the motive is a relevant factor. We're just looking for the chronology of 24 cases to be part of the subject paperwork. So two brothers and the defendant's father were killed as part of this story, and we pretend that this is a clear murder of revenge”, Kosovo Special Prosecutor's Prosecutor said.
The controversy also came from the prosecutor when the defence proposed some evidence through the court's handed-over parade.
The defence had proposed as evidence a Serbian ID for what Granit Elshani was told to argue was regular entry into Kosovo. With this evidence, Granit Elshan's lawyer exposes the claim that the same has come for revenge purposes.
He said that the purpose of the arrival of Granit Elshan was to issue documentation to move freely.
The defense also proposed several critical night pictures when the incident at the “City Club” was taking place on January 2nd of 2010.
Prosecutor Adrew Hughes rejected these defence proposals by reasoning that these evidence will only prolong the trial, which he said is nearing completion.
During today's hearing, Ilir Kukaj, chief of the ballistics Division at the Kosovo Agency for Forenzice in Pristina.
He told of the testing of weapons, bullets in the bodies of the victims, and shellings from gun shooting.
In the prosecutor's question, the ballistics expert said he received some evidence from the Pec Police Regional Investigation Directorate about the case in 2010.
Rukmane Hyseni, wife of Granit Elshan's nephew, has also been heard in the quality of the witness.
During her testimony she said that the critical night of Granit Elshani was a guest at their home in the village of Ramun of Pec.
The Witness said that Granit Elshani had never left home that night.
It was also confronted by the prosecutor with earlier statements about this case, but said the truth is in what it declared in the last two times.
According to the indictment filed against Granit Elshani for the event that took place on the night of January 2nd 2010 at the “City Club”, it is claimed that accused Granit Elshani had entered this discotheque and two pistol “TT” was beginning to shoot in the direction of the late Besart Sobhab and Valdet Kelmendi.
As described in the indictment, on the critical night of Granit Elshani's murder, there was a member of the Kelmendi family, Valddin, but bad luck had Besart Sohab, who had shot close by him.
Jevdet's brother Valdet Kelmendi, known in the town of Peja by the nickname Lara, was killed in the middle of town in 2014 by a hail of bullets that were fired from a Jeeplike car. On that occasion an elderly person lost his life and five others were injured.
The Special Prosecutor claims that in the conflict between two families, 29 attacks have been carried out, resulting in 23 deaths, 10 members of the Kelmendi family, three of the Elshani family and ten victims of the case. Two more children are among those killed. /Call. com/
