Ramiz Kelmendi at the Court for Power Stealing “Elkos”: I have nothing to add

LDK MP Ramiz Kelmendi, formerly owner of the company “Elkos”, is being charged by the Constitutional Prosecutor in Pristina, that during 2011, he has committed the criminal work “serious returns”.

He is currently accused of stealing electricity, where he owns “Elkos”, according to the prosecution, has damaged the Kosovo Energy Corporation (KEK), in the amount of 22.801.19 euros.

The prosecution claims that after KEK workers have gone to his company, they have noted that Kelmendi has unauthorizedly exploited electricity, not registering two-thirds of the energy.

In this regard, the former deputy prime minister of Kosovo on Monday has appeared at the dock at the Constitutional Court in Pristina.

Kelmendi, who has not had a defence attorney, has rejected the prosecution's indictment, claiming he stands close to the controversial writtenly handed down.

I remain completely close to opposition and have nothing else to add to”, Kelmendi briefly said at Monday's session.

In his objections to the indictment, Kelmendi has stressed that in all of his company's working units operating throughout Kosovo's entire territory, each is responding to its own work.

He has also said that his company's legal office, having been disgruntled with KEK's report, has filed complaints in the first and second degree, and after the rejection of the predecessors, according to him, has fulfilled the obligation.

Kelmendi has also stressed that all of this is caused by KEK officials, of the District in Pristina, in order to cause it damage and tarnish its name.

According to the reasoning she has given, Kelmendi says KEK workers have never checked the transformer in the presence of responsible persons, but they have informed responsible persons after the raid.

According to Kelmendi, during the time period for which the prosecution accuses him of misusing electricity, it has stressed that there have been frequent blackouts of electricity, and after the generator's locks and cracks, it has been able to damage any delivery, but that the damage could not cut power.

Kelmendi's objections, prosecutor Menduhi Kastrati, have deemed them unstable and called on Judge Rrustem Begolli to make a decision for their refusal.

The Founding Procuror in Pristina, has accepted the accused's parachute that concerns opposition to evidence and the request to cast the indictment. We've analyzed the defendant's parachute and at today's hearing we're verbally declared opposing the same parachute. The accused in his statement has attached some evidence that are not in the polls, such as submitted a list of which is evidenced to be the deputy of the 4th legislature, then, a copy of the business number, a business registration information, consumer transactions released from the damaged side, and also a work contract of a worker working under his business”, prosecutor Kasttra said.

He has added that from these evidence, he considers that there is not enough basis for the court to act on approval of the accused's motion.

The prosecutor has stated that the indictment has sufficient attached evidence proving the justified suspicion, with which he has asked the court to decide on its decision to refuse the request to contest evidence and drop the indictment.

Judge Rrustem Begolli has declared that the court will take written action regarding the defendants' objections and that they will then be handed over to the parties.

Otherwise, at the initial session, held on December 21, 2017, accused Ramiz Kelmendi was declared innocent.

According to the indictment of December 12th 2012, which has provided “Justice Vow”, Kelmendi is charged with serious criminal activity “serious recovery”, due to the suspicion that from unproved date until June 30th 2011, the company “Elkos”, in Fushe Kosova, Kelmen's property has been misusing electricity.

The prosecution claims that when KEK workers have gone to do searches at that company, they have found that the intended defendant has been unauthorizedly exploiting electricity, as two transformatators of the current that have been out of measure have been found, while one component was cut off from the connection.

On the basis of the indictment, with these actions, two-thirds of the electricity had not been registered, with what KEK has done damages worth 22.801.19 euros.
