Reasons brought to the accused's death by Zenepe Berisha

On 12 April this year, Prizren's Constitutional Court had declared 12 years in prison against Negoti Berisha for killing his wife, Zenepe Berisha.

As the Court of Appeals found the defense attorney's claims groundless, complaints of the prosecution and the damaged party were described as being based.

The Court of Appeals, having approved the prosecution's complaint and the damaged side, changed the Prizren Constitutional Court's ruling by raising the sentence from 12 years to 6 months in 17 years in prison to Nebil Berisha.

The College of Courts of Appeals made that decision after claiming that the Constitutional Court in Prizren during the measurement of the sentence has not acted correctly.

According to the assessment of the Appeals Court, the first-degree court in this legal case, even though it has come to terms with the extenuating and critical circumstances found in the accused, the same has not really appreciated, and especially the extenuating circumstances of the essentially reduced responsibility which it has overestimated, especially in view of the minimum and the previous maximum penalty for severe murder”, states the Apel Court ruling.

Furthermore, the Court of Appeals finds that the court in Prizren has not deemed even the defendants ' critical circumstances directly.

The “have not been directly assessed in the concrete case, nor in the most serious circumstances, and especially in the manner of committing criminal acts, where the accused in the presence of minors is now life-pared by Zenepe Berisha, beating him 20 times in all parts of the body”, the Court of Appeals Act states.

The fact that the victim has been hit 20 times, according to Court of Appeals judges, shows the tenaciousness in committing criminal acts, also doing so in a harsh and brutal manner.
