The Toggenburg District Court in Lichtensteig has been taken over, writes Tagblatt.ch. In late June, the two owners of the firms were indicted by the prosecution, which had sought fine sentences for the two Swiss. One was to pay 1,000 francs, while the other 3,000 effective fines while being sentenced on bail by 70 daily units each broadcast albinfo.ch. The basis for such convictions lies in violating Article 117 (1) of the Law for foreigners without permission.

The two Swiss have been protected by the same lawyer, who has sought release from criminal responsibility for his two clients.

Even though the training for asylum seekers is not allowed, the problem in this case is not that simple. That's because one of the two Kosovars, as one of the indictees has testified, the Cantonal Office for Professional Education had approved the contract for certificate training. The initiative for the professional training of the two Kosovars (a girl and a son) had been given by the leader of a nursing center, where the two young people lived.

The problem here lies in the fact that the asylum demands of the two Kosovars were rejected, albinfo.ch conveys. In fact, one of them was awaiting the answer to the second demand for asylum, but this is considered a multiple request. Turn down asylum seekers, as it is known, have no right to work or professional qualifications. The Cantonal Office for Migration has let two Swiss employers know about the situation, so they have suspended contracts for professional qualifications with two young Kosovars. But the two indictees have continued, however, to engage disorderly and with small volume in a professional type of practice. By doing so, they say to have relied on the Council of Asylum's suggestion, under which the move is allowed. The aforementioned, in a written statement sent to the court, admitted to making this suggestion.

In the end, the court has made a clear decision for both the Swiss, but the verdict is not yet powerful. The judge has said that declaring innocence is imposed because condemning the accused would be an urgent measure.

The figure of the criminal employment work of foreigners without permission to stay in this case has been met. According to the law, even working hours are considered employment, and even when it is not paid, it transmits albinfo.ch. But the judge considers simultaneously that the two employers mentioned are not foreign rights experts. They are based on reports the head of the asylum centre has given them. They have done so in spite of previous contact with the Migration Office. For this reason they must be freed from guilt and condemnation.

The judge has recalled that the article mentioned 117 (1) is meant to punish employers who hire and exploit workers in black, out of greed for profit, conveys albinfo.ch. In concrete cases this is not the case, the reason for the decision is stated.

On the other hand, it is found that, meanwhile, the leader of the Cantonal Department for Security and Justice has promised two young people special permits for pursuing professional training.
