Lawyer Palushi in an interview with journalist Muhamet Hajrullahu said that if the Special Court law is abolished, then the United Nations Organisation can form this court (OKB), based on Resolution 1244, which is in force.
Palushi said the most problematic step would be to transfer the Special Court to the international level, respectively.
Such trials or tribunals are formed in two ways either through the UN or through the two states' agreement. Our case is this second. If we want to cancel these steps the issue goes to the international Security Council by relying on the 1244 framework and lose the support of our friends, neither will our voice be heard in”, Palushi said.
The lawyer further said the law for the Special Court cannot be easily abolished, as the Constitution of the Republic of Kosovo should be changed.
“We had two moments or events, and the first we have associations coming out of the war with a petition of 15 thousand Kosovo citizens, and we have 43 Kosovo Assembly deputies seeking the abolition of this court. The Petition They Taking O V L-KLA is a legislative initiative. Disinherance cannot happen much simply after the law has to be changed and annulled, as well as change Article 162 of the Constitution of the Republic of Kosovo”, he said.
Lawyer Palushi also indicated that the American and British ambassador's warnings have been very serious and decision-making.
