Avoid having sex with women who consume alcohol, watch out for men

Kathy McCuloch has said that she has experienced in 34 cases of sexual rape, so she advises men who have sex with drunken women to be deemed misuse.

“The law is simple. If a woman drank and said that after sex, there was no choice, that there was no freedom or capacity to consent, then the husband would be accused of raping”.

There's no protection under the law for a drunk man. The real question is there is no legal definition about what very drunk means.

“Test is via whether the drink has influenced the woman's ability to make the decision to have sex”, she said.
