Power statements for Serbian judges, prosecutors urgently bring Emissar to Pristina dialogue

The incumbent on the president, Albulen Haxhiu, in mid-June, called on the Judiciary Council and the Prosecutorial Council to approve the resignations of Serbian prosecutors and judges, who had resigned in late November 2022, in the context of the collective departure of Serbs from Kosovo institutions to Serb majority municipalities in the country's north.

They had later withdrawn their resignations, but the Prosecutorial Council rejected the prosecution's request.

The KKP sent Hadzi for the decree of their release, which immediately decreed it. This Haxhi decision was criticised by the European Union, writes Express, broadcast Periscopi.

Just as the KKP is being asked to act on the Kosovo Judiciary Council by Kosovo's incumbent leaders.

Two days ago, pressure on the KDRS began by several elected deputies of the Vetevendosje Movement.

There are 10 Albanians there [in the KDR], who didn't even have to talk about it, so leave me alone. But I want to believe that the Albanian screech that went to the assistant Vuqit”, elected MP Adriana Matoshi wrote on Thursday, a day before the KDRCUIW meeting.

Such reactions by Vetevendosje officials reacted to the European Union, which sought not to put pressure on the KDRCH decision making.

“The EU in Kosovo calls on all political subjects to refrain from exercising pressure on the Kosovo Judiciary Council and its members in the decision-making process. An independent, impartial and apolitical judicial system is essential for the rule of law in the EU and in Kosovo”, the EU Office in Kosovo said.

This call except for ignoring it, Haxhiu sent a message to the international “partners.

Friday morning, U.d. The president, after announcing that she has set August 5th as the date for holding the constitutional session, stopped the subject longer.

She called the conference a few hours before the KDRC meeting, where in order of the day it was her request for the resignations of Serbian judges.

Initially, Hadziu referring to “data” that has access to Serbian judges and prosecutors, as well as to the administrative support staff, said their extenuating “s have benefited and continue to benefit financial resources from Serbia in various forms since 2017 and so far”.

So even during the time they were prosecutors and judges were paid by Serbia. The game shown for Serbia has also been rewarded by financial means at the time it is expected that the same will exercise their mandate in behalf of citizens”.

After this statement, Haxhi turned his attention to the KRCH meeting.

Our “Our eyes are at the Kosovo Judiciary Council, and this is very important because if the KRK acts contrary to the legislation in force then here is a very dangerous precedent and with an abuse of responsibilities they have. I once again call on them to implement the legislation in force and not to fall prey to the influences of anyone, local or international. So I am unable to let those judges get out of office because the KGK is operating”, Haxhi said at the conference.

Denying that its statements constitute pressure on the KDR, Haxhi said it concerns “press” that members of the KDRC) are coming from internationals.

What worries me is the pressure that can come from our international partners. I have had meetings with them and have openly told them my constitutional responsibilities. So should members of the Prosecutorial Council and those of the Judiciary Council. Just to be based on law. The situation here is clear. There's a chance to interpret”.

Then she turned to internationals.

Who of our partners, who today put pressure on advice, who would allow their countries to have judges and prosecutors being instructed by another country? Who of the international partners, who are always calling us for the rule of law and independence of the justice system, would require judges and prosecutors who are members of the council to decide something contrary to the legislation?”.

The charges on this matter took place at the KDRCI meeting, which ended without the result of Hadzi's earnest request.

The Kosovo Judiciary Council meeting was postponed due to lack of quorum, as some members have issued the meeting.

Before that happened, the leader, Rrustem Thaqi, had a debate with KDRCH member Bashkim Hyseni, who told him he has responsibility for the case. But, Thaci said the issue has been actualised. The president has been able to raise him and Hyseni.

What did Kurt say afterwards?

At the start of the cabinet meeting, Prime Minister Albin Kurti also spoke on the matter.

Like Haxhiu as well as Kurti asked the Kosovo Judiciary Council to act the same as the Prosecutorial Council against the European Union's calls not to put pressure on the Council's decision making.

“These resignations were addressed long ago by Kosovo Police and days ago even by the KKP. And today, as we expected the KDR to do the same, we realized that the meeting failed in the absence of quorum. We expect at the next meeting to receive such epilogues as well as this”, Kurti said.

We had political rights to tell you not to go, but we have constitutional and legal rights to tell you back. Their departure has been political, individual, although organised, but the return is legal and constitutional issue”, Kurti said, adding: “There can be no return overlapd to the Constitution of Law”.

These developments rushed to Pristina the emissar of dialogue, Peter Sorensen, on an unprecedented visit.

To inform the prime minister's office after Kurt had received a late afternoon meeting.

“Responding to Sorensen's envoy over the issue raised by him for the return of Serbian prosecutors and judges, Prime Minister Kurti said the Kosovo government affirms and insists on constitutionality and legitimacy, equality of citizens and involvement of all communities. Employees in the Republic institutions are and should be of all ethnicities, characterized by professional competence and ethical integrity, including police, judiciary and state prosecutor. The collective resignations of the previous four years in the north of Ibri were precisely aimed at destroying the multiethnic composition of our democratic system. Now the road ahead is what the Constitution and the laws of Kosovo define, which in the case of the judicial system means preserving multiethnicity, but also ensuring independence and quality of justice”.

Sorensen himself has yet to announce this meeting with Kurt.
