Meanwhile, his defence has rejected the prosecution's request for the detention assignment, arguing that there is no danger of repeating criminal acts, reports “Justice Vought”.
Kelmendi's lawyer has stated that, according to life experience and psychology, when a person reacts impulsively, there is usually no danger of the same action being repeated after a short time.
According to him, the fact that this case has become a major public outcry should also be taken into account, and that the suspect is aware that the investigation has been conducted against him.
The defence has also stressed that, on the basis of Article 159 of the Republic of Kosovo Criminal Procedure Code, which defines the principle of proportionism in setting security measures, detention would not be proportional. According to Artan Qerdin, the Genist's defence lawyer, for the first two acts Kelmendi allegedly provides a prison sentence of up to a year or even a fine.
The defence has also announced that their client is willing to enter into a plea agreement, stressing that this would ease the procedural risks.
Lawyer Qerkini has added that the detention assignment would also burden Kelmendi's financial situation, stressing that he for a time has not performed because of family issues and has not received access from the company “Onima” in a regular manner.
However, the Constitutional Court in Pristina, after reviewing the parties' claims, has assessed that the prosecution's request for the detention assignment is based. According to the court, there is doubt that Besart Kelmendi has carried out the criminal acts described in his decision to start investigations and in the request for detention, as well as the risk of escape, the impact on witnesses and the repetition of criminal acts.
The Constitutional Court in Pristina has assigned a month-long detention measure to singer Besart Kelmendi, suspected of criminal acts of beating, damage to property and possession without gun permission.
According to court documents, a Radikal weapon was seized during the arrest of the defendant RP-X9, 9 mm calibre, with a number of TK 934-24A02839 series, as well as a 13-foot-mm calibre clip.
The event is suspected to have occurred on March 11th 2026, around 14:50, at studio facilities “Onima” in Pristina's Veternik.
According to witness statements given to the police, Kelmendi had entered the facility and had begun looking for the company's director. Witness with the initials A.K. has claimed the suspect had demanded that the director be called and had threatened to break the computers if he did not appear. At one point, according to him, Kelmendi had hit a computer and then pulled a gun out of his bag, which he had held in his hand for a short time and then pocketed.
Witness E.H. and declared that he heard shouts and noises in the object, and when he was gone out he saw Kelmend. He said he tried to calm him down and send him to the office, but according to him, the suspect kept screaming and looking for the owner of the company, threatening to kill him.
Meanwhile, witness L.S. has claimed to have seen Kelmendi leaving and then breaking his computers, and one of them had kicked him. According to her, he held a gun in his hand and said he would destroy the object while breaking several windows during the incident.
And E.H. witness. has claimed that while he was at work he heard threats to the company's director, saying that if he didn't appear immediately he would kill him and break all the equipment.
For these reasons, the court has decided that Besart Kelmendi would be appointed a month-long detention measure, calculated from March 11th to April 9, 2026.
