Despite successes not only in terms of security but in other areas, Kosovo as a state is also facing a challenge, with the judicial process under way in The Hague against former KLA leaders now approaching the decision-making phase. After a long and complex trial, the defence team has expressed optimism about a positive epilogue, stressing that the prosecution has failed to argue charges with convincing evidence.
Following the conclusion of final statements in the case of Thaci and the other lawyer Skender Musa stated that conflicting evidence has been presented during the process and that, according to him, material evidence is missing to support the charges. He stressed that law language refers to a lack of substantial support evidence and that the evidence presented has not proved elements of the criminal act, therefore optimistic that the decision will be positive.
After analyzing all these proposals and evidence that are written and recorded through video cameras in recordings during sessions, the court will decide. I believe the verdict was a release in view of this situation. But you can never prejudge the issue of decisions”, he said.
Musa says the prosecution's request for a 45-year prison sentence is contrary to the Kosovo Criminal Code, until he spoke of the importance of having a free decision for former KLA leaders, but also about the consequences of another decision.
The “is very important for the country to have the decision set free on this issue because the Kosovo Liberation Army's entire war, the war of the people of Kosovo and the way of Kosovo's declaration of independence is cleared. Though politically-juridical there is no war beyond the right to protect and cannot be tarnished because of a court. The consequences in the first place will be high because we are dealing with the leader of the KLA's General Staff, the leader of the Government of Kosovo, the person who has declared Kosovo's independence, and of course propaganda, Serbian, Russian diplomacy and their allied countries, China and the non-democratic countries of the world, will lobbi much to prevent Kosovo from membership in international organisations, the UN and others, will lobby for its recognition “, Musa said.
Meanwhile, Thaci's lawyer, Luka Misetic, after completing final statements has expressed optimism of a positive result. He stated that after the arguments heard by both sides, the final decision remains in the hands of the court./Periscopi/
