1. The European Parliament expresses regret that the Serbian parliamentary and local elections held on December 17th 2023 deviated from international standards and Serbian commitments for free and fair elections due to continued and systematic abuse of institutions and media by officials to gain an unfair and unwarranted advantage, believes these elections cannot be considered free and fair; it is alarmed by the widespread and systematic abuse of institutions and fraud that threatened the integrity of elections in Serbia.
2. Noting that the MVZ noted that the election day passed smoothly, but that it was marked by numerous procedural shortcomings, including the unstable implementation of safeguard clauses during voting and counting, frequent cases of overcrowding, violations of the secret vote, and numerous cases of voting in the group; (PPE 1) expresses its serious concern about those irregularities and the general electoral environment, which fell well below the standards expected for an EU candidate country, reminds Serbian authorities that the proper functioning of Serbia's democratic institutions is in the basic process of Serbia's accession and EU membership.
3. Notes with serious concern the numerous evidence gathered by international and local observers showing illegal activities that led to and during election day that changed the outcome of the elections, significantly impacted the election results, especially for the city of Belgrade and seriously damaged the legitimacy of parliamentary elections.
4. It requires an international investigation independent of respected international legal experts and institutions for irregularities in parliamentary, provincial and local elections, with specific reference to the Belgrade City Assembly elections as specific accusations, including those related to organised voter migration at the local level, exceed the frames involved in O's reports. SBE/ ODIHR, stresses that the results of this investigation should be reported to the European Parliament; supports the quick deployment of an ad hoc fact-finding mission in Serbia as part of this international investigation, with the participation of the European Parliament;
5. European Parliament calls on the European Commission to launch an initiative to send an expert mission to Serbia, which could include experts from O SBE/ The ODIHR, the Venice Commission and the Council of Europe, in order to assess the situation with recent elections and post-election developments in an effort to provide preconditions for establishing the necessary social dialogue that would lead to the restoration of public confidence in institutions and the assessment and resolution of systemic issues of rule of law in Serbia, based on the “pressions of Priebe” for the rule of law in northern Macedonia and Bosnia and Herzegovina.
6. The EP expresses regret over the lack of institutional answers to serious allegations about the involvement of current officials in manipulation and electoral abuses, which maintains impunity and ensures the continuation of this practice; we note with concern that some of the election irregularities that led to elections in December 2023 represent possible criminal activities under Serbia's law and Constitution; we stress that this practice will continue to undermine confidence in the processes and election institutions in Serbia, if allowed no consequences, by irreversibly preventing democratic governance and further integration; we emphasise a total investigation into the elections, including the latest constitutional court for the elections to enter into Belgrade's elections on December 17th, 20th).
7. We condemn the lack of results in prosecuting and sanctioning criminal acts in the elections, including grave accusations of illegal manipulation of the voter list and vote rights, pressure and intimidation of citizens and candidates for elections, corruption cases, counterfeiting citizens. signatures, clientlitism, illegal and illegal misuse of citizen data, abuse of state position and lack of effective mechanisms to prevent governments from gaining an unfair institutional advantage in the elections;
8. We call on Serbian authorities to investigate, prosecute and bring to justice those responsible for criminal acts during elections and attacks on students.
9. The EP condemns attacks by government officials, particularly Prime Minister Ana Brnabiq and President Aleksandar Vucic, on election observers, including members of the European Parliament, and calls for a return to a humble and constructive course, stressing the importance of mutual respect in democratic countries. Process; The EP is deeply concerned about efforts to discredit and intimidate observers; we urge Serbian authorities to take all necessary steps to avoid any further deinformation campaign against election observers and to create conditions that enable local and international observers to carry out their work effectively, to protect them from any violence, threat, revenge, harmful. 10. We call on Serbian authorities to offer institutional solutions to overcome current problems; we call for the proper functioning of parliament and government, without a continuing cycle of campaigns and frequent special elections.
11. It calls on Serbian authorities to restore the trust of electorate across the process, enable full transparency of electoral procedures, and ensure accountability of authorities conducting elections or interfering with them; we urge Serbian authorities to co-operate fully and essentially with O SBE/ ODIHR, the European Union and the Council of Europe and enable a comprehensive process in ensuring electoral rights and freedoms, institutions and processes, with the participation of local election observers and political parties;
Twelve. Note with concern that Serbia has not implemented many past OSCE recommendations/ The ODIHR for the main issues of the election process, despite repeated calls to do so, including the European Commission; we noted the recent changes that addressed some of the previous recommendations of the ODIHR and the Venice Commission, especially those related to the legal framework for financing election campaigns.
13. We call on Serbian authorities to fully implement past OSCE recommendations/ ODIHR and Venice Commission without further delays; We welcome the ODIHR's final report and call on Serbia to implement recommendations from the Venice Commission's Joint Opinion from December 2022 on the constitutional and legal framework regulating the functioning of democratic institutions in Serbia, especially for the access of competitive candidates to the media, increasing transparency and responsibility for campaign financing. This recommendation also refers to measures to suppress pressure on voters, misuse of administrative resources, which must be applied in consultation with the OSC experts well ahead of the upcoming elections, prevent new irregularities and frauds and guarantee the country's democratic functioning.
14. We call on Serbia to implement the long-standing recommendation of the ODIHR and Venice Commission to conduct a comprehensive review of the Unified List of Voters to address the concerns of accuracy, including claims of voter migration and death records; The EP is concerned by claims that the Unified List of Voters has already registered a considerable increase of voters in cities where local elections will be held later in 2024.
