The Constitutional Court has approved Prizren's Commission's request for the provisional measure in terms of assessing the constitutionality of Article 5 of the Law for Taxment in the Palmy Property, which has entered into force on 16 August 2023. For implementation of this decision, the Constitution has decided on a temporary move until November 30th.
“Gjycatta, unanimously, has decided that (i) the requirement for setting up the provision of the provision in terms of the above act adopted in length until November 30, 2023; and therefore (i) the implementation of Article 5 of the No.08/L-224 Law for Change and Fulfilling of Law No. 06/L-005 for Taxation in the real estate and implementation of decisions issued on the basis of this article until the high term”, the announcement said.
On this issue, in a proposal for Gazeta Express, the head of the Kosovo Communist Association, Sazan Ibrahimi, has spoken.
He said he welcomed the Constitutional decision, until he added that he believes the final decision will also be in favour of municipalities.
“We as the Association of Kosovo municipalities have always trusted the decisions of the Constitutional Court and the division of justice. We have been convinced that this decision will be in favour of municipalities, we welcomed this decision and we believe that the final decision will also be in favour of municipalities, that otherwise municipalities will lose about 30m euros”, Ibrahim said.
He also had criticism of the central level, which he asked for more co-operation with local institutions before making decisions.
This decision proved that the demand of municipalities is fair that the central level without consultation is making decisions that would affect the municipal budget and these decisions are being made without prior consultation. Instead of taking the central level down with the local level of discussion these problems, he's forcing us to go and face the courts. It is the appeal of Association that in the future the central level will open its eyes and co-operate with the local level correctly and honestly so that we do not have such confrontations in judicial institutions”, he said.
But so far the decision to forgive 100 euros has been implemented by the municipality of Drenas, Obilic and Gracanica. What happens to these municipalities, Ibrahimi said they should wait for the final constitutional verdict.
“As far as municipalities are aware, we should expect the final verdict by the Constitutional Court”, Ibrahimi said.
The Property Tax Law was passed on 10 July, with 61 votes, two abstentions and none against. Meanwhile, the opposition s '% had participated in the vote at all, saying they would send it to the Constitution. The mayor of Prizren, Shacir Totaj, has later sent him to the Constitutional Court, with the argument that he cuts the municipal budget in Kosovo.
