Court suspends road closure decision in Pristina

The decision was made on August 30th by Judge Vlora Pacolli-Rexhepi, the Justice Vow reports.
“APROVOWED as based on request from the group “COHA”, Sh.p.k., for delaying the execution of the decision. THE execution of the decision by No.12-020.05- 171446/23 of the 1808.23, published on the date of 21.08.23, issued by the head of Kosovo's capital, until the court decides with the final judicial decision in terms of the indictment of the plaintiff”, it is said in the verdict.
In reasoning on the verdict, it is said that on August 28th, 2023, the plaintiff/proposor Group “Koha Koha” -- represented by managing director Flaka Surroi -- has filed charges against indictees/oppossessors of President Practic Rama's proposal for delaying the August 18th 2023 decision, which was issued on August 21st 2023.
The decision is said to have stressed that President Rama, with the August 18th decision, has decided to close three city roads for circulation, which pass to Pristina University Park “Pristina” and the National Library, starting on September 1st 2023.
It says that the group “proposor Koha” is a medium found on the “George Bush” route, which accesss the parking lot of their property object, legally exploits the “group, regularly and alone from this route, while closing the motor vehicles on the roads/rest roads that go to the UPP and Library Park, “ <ex5> approach is found in the parking area that is located in its target.
The ruling states that after the Court reviewed the plaintiff's claims, it estimated that in concrete cases legal conditions have been met to approve the indictment, since the plaintiff has argued that the execution of decisions would bring harm that would hardly be repaired.
He has also reportedly argued that the postponement is not in conflict with public interest; nor would it bring serious harm to the opposing side.
The court estimates that the execution of the contestant's decision would bring difficult irreparable damage because the execution of the verdict would prevent plaintiffs/proposors from accessing the working object of the Group “COHA”, which would cause disorders and difficulties that would directly affect the functioning and exercise of regular activity for obtaining information and informing the public”, the decision says.
Further, the execution of the decision would reportedly have financial consequences for the accuser.
The court estimated there is no circumstance under which Pristina's indictees would be caused any damage by the delay in executing controversial decisions until the court makes its final decision.
