In the criminal conviction provided by the “Justice Vow”, it is said to have been acted in opposition to the Supreme Court's court, the Court of Appeals, and the Constitutional Court, through which decisions were decided not to carry out the education process in closed schools until the merit imposedion according to the indictment.
“The suspect has acted contrary to the following judicial decisions: (1) Kosovo Supreme Court Act, Numbered ARJ No.67/2022, dated 2508,2022; (2) The Kosovo Appeals Court Act, A.A.n.322/2022 Administrative Affairs Department, and (3) The Constitutional Court Act in Pristina, the Department for Administrative Affairs, number A.n.202/2022, dated 21,03.22, empowered by 25.08.22 (now, all three decisions together referred to as “judicial decisions”)”, is said to be criminalised.
In addition, judicial decisions are said to have been taken in the administrative conflict initiated by Venhar Rahimi in quality by the plaintiff/proposors and by Central Kastrati, in terms of the interest side, against the Kamenica municipality in quality of the indictee.
“Judicial decisions are made in the administrative conflict initiated by Mr. Venhar Rahimi in quality of the plaintiff/Proposor and among the Castrati quality of the Pope of Interest, against the Kamenica municipality, in quality of the indictment”, is further said.
It says that the subject of this dispute was the decision of the 390 Kamenica municipality, December 29, 2021, and that through court decisions of three degrees, it was decided not to have the learning process in closed schools until the merit settlement was filed according to the indictment.
Under the No.390 verdict, the Kamenica municipality has partially abolished another decision made by it, from Central Kastrati as head of the municipality, on the 09.09.2022, numbering the 19870 protocol, (“Location No.19870 <x2). Meanwhile, through the judicial establishments, the courts of three steps have approved my and Vanhar Rahmi's request and postponed the execution of the No.390 verdict. Consequently, courts have enacted the No.19870 verdict. This means that courts have decided that, until merit is placed according to the indictment, there should not be an education process at the Initive and Low Middle School “Skenderbeu” ( ShFMU “Skenderbecu”, in the village of Kopernica, ShFMU “Sadri Misini”, in the village of Shipashnica Poshta, ShFMU “Aslan Thaci”, in the Post Karaces, ShFMU “Jälal So”, in Petroc (the other referred to as “The closed schools”, in the municipality of Kamenica”, says the criminal outcry.
But, it is said, despite the courts' ban on continuing teaching in those objects, Iryer Rahimaj and other responsible members of the Kamenica municipality have ignored the courts, respectively.
This is because they have allowed learning to be developed in closed schools early in October 2022 when even the school year began at Kosovo's Initive and Low Schools. The same is attested to by SFMF journals “Skenderbeu”, said at a criminal release.
In addition, criminal charges were exercised even under suspicion that the suspect committed criminal work “The judiciary”.
Because of the court's contempt, failure to implement judicial decisions, and allowing the development of the education process at closed schools, respectively, results in suspects trying to decide on their own. Such arbitrary actions allowed by the suspect, unilaterally, as we have argued earlier, are contrary to judicial decisions and consisting of committing the criminal act of self-trial”, reportedly criminally.
Kastrati has asked the Constitutional Prosecutor in Gjilan that, after the murder of criminal charges, issue a ruling on the launch of investigations against two other possible suspects and suspects and then freeze the indictment for committing the above-mentioned criminal acts.
“As a consequence, I request from the Constitutional Prosecutor in Gjilan that, after the merit review of this call, issue a verdict on the launch of investigations into suspects and other possible suspects and, later, freezing charges against suspects due to the conduct of criminal acts in question”, it is said in the end.
