What will happen to public officials' salaries after they contest the law?

The reduction of wages that have undergone risings is not the goal of the ombudsman, the request is reported.

The people's <x0 Group does not object to the law and additions in areas where there is an increase of wages for specific sectors and where a legitimate goal for such increases is pursued. The ombudsman draws attention to the Constitutional Court's stances expressed in paragraph 271 of the verdict KO 219-19, under which any wage reduction should be such as not to place the burden of salary cuts in just some persons or specific sectors of the public sector. The reasons for lowering salaries should be multiplely sustainable than the reasons for salary increases”, the Ombudsman has said.

Although the interim move has not been requested, the court could take such a decision, according to the Kosovo Institute for Justice, which has been one of the complaining parties.

“This does not mean that the Constitutional Court, during the assessment of the request, if you find it reasonable to suspend, the law as a whole or certain part of the law where it notes that it is reasonable not to do an irreparable damage to public sector employees in Kosovo”, has declared Naim Jakaj by IKD.

On the other hand, lawyer Florim Shefqeti, who has also represented complaining parties for the Law of Salaries, says confident that he will bring down the Constitution.

Shefqeti says the demand for a measure of suspension, the ombudsman can do it already.

“This law has violated the independence of the judiciary, which is a pillar, and we have repeatedly said that this law in the form that is still going to be unconstitutional, in the part that has become a violation of rights from the legal equality part, and the ombudsman has interpreted it as a violation of the right on property because their salaries are considered economic interest, respectively, as the type of property”, said Florim Shefqati Lawyer.

The Law on Salaries has been adopted in the Assembly in February of this year, where the value of the cofficient is set at 105 euros.
