The 8.4 million tender of the Pristina municipality is declared the winner of fraud and malpractice in public procurement

In the media communiqué it becomes known that the winner of the tender about the prosecutor's activity “construction of the A First Part” has been declared Naim Sa God, former owner of “Sada” sh.p.k. is convicted of fraud and misuse in public Prosecution.

“AVONET during research of procurement activity in the Pristina municipality has identified that Naim Sallah, former owner of “Salla” sh.p.k has a firm form Act and is guilty of committing criminal acts: falsification of official document by Article 398, par. 2 KPRK, no. subject PKR. No. 16/2018 of the 30.03.2018 Pristina Foundation Court. ” said in communiqué.

AV ONET has made it known by law:

The economic operator has no right to participate in a procurement activity or the execution of any public contract, if such an economic operator, any manager, manager or director over the past ten years has been found guilty by a competent court for carrying out a criminal or civil offence, including corruption practices, money laundering”.

The NGO network for findings from this monitoring has asked the State Prosecutor to start investigations.

AV ONET is constantly monitoring and exploring procurement activities initiated by the Contractive Authorities in order to stop misuse and fraud in public procurement.

In this continuation AV ONET has monitored the procurement activity” Construction Road A. . Procurement: 616-22-7096-5-1-2, initiated by Pristina's Competition Authority.

The Pristina municipality with the date 24.02.23 has recommended contracting the Economic Operator Group “SA LARK and ALTI S It's worth 8,497,801.66.

AV ONET during research of procurement activity in the Pristina municipality has identified that Naim Sallu, former owner of “Salla” sh.p.k has a firm form Act and is guilty of committing criminal acts: falsification of official document by Article 398, par. 2 KPRK, no. subject PKR. No. 16/2018 of the 30.03.2018 Pristina Foundation Court.

So, based on NR Law. 04/L-042 for Public Procurement in the Republic of Kosovo, respectively, at Article 65, paragraph 3, which determines that:

The economic operator has no right to participate in a procurement activity or the execution of any public contract, if such an economic operator, any manager, manager or manager over the past ten years has been found guilty by a competent court for carrying out a criminal or civil act, including corruption practices, money laundering”.

AV ONET, seeing OE “Salla” sh.p.k with former owner Naim Sallah already has an act of firm form under the Laws of the Republic of Kosovo, considers that this economic operator is denied the right to receive (offer) part of the procurement or execution activities of any public contract, according to the NR Law. 04/L-042, for public procurement in the Republic of Kosovo, Article 65, paragraph 3.

AV ONET reviewing OE bidder “file documentation Salla” access to project procurement activity titled” Construction of the A BAR First part by No. Procurement: 616-22-7096-5-1-2, with the actual contracting authority Pristina Community has seen Naim Sallah as OE official “Salla” shpk, where it figures in the wages list for 2022 issued on the date of 05.08.2022, as well as for 2021, 2020, 2019 and 2018 in the form of annual statements and payments for transportation incomes, where it figures as contact person Naim Sa God, also in the Notification of the ISO certificate that has issued the request. Naim Sa God, issued in the name of “Salla”spk, proving he has leadership position or position in the OE.

These documents that are in the supply file have fulfilled the tender file criteria, resulting in OE and its representative. Lulzim Sadu allegedly committed criminal acts of abuse and fraud in public procurement, and false statements under oath, and this act is sanctioned with the Republic of Kosovo Penal Code and punishable with KODI's Article 415 REPUBLIC PENAL COSOWY, NR. 06/L-074: Misuse and fraud in public procurement and Article 383, false statements under oath.

AV ONET's finding out about this monitoring has asked the State Attorney to start investigating by attaching the report and the allegations posed by this study/monitoring.

Also, found by the Research and Monitoring Report has been sent to the AK, the head of the Pristina municipality to take appropriate measures and actions in line with the Law.
