EU: Nenad Rasic's appointment as minister for communities is unconstitutional

EU spokesman Peter Stano, at a news conference, has indicated that appointment of ministers, in particular those representing non-most communities, should be made in line with the Kosovo Constitution.
“The EU and its member states call on Kosovo to ensure that all necessary procedural steps on the case of appointing ministers representing non-most communities are fully respected”, Stano has said.
According to Stano, the Union expects the appointment of Serbian politician Rasic as minister for the Community to establish Kosovo's Constitutional Court.
“Respecting the Constitution is key and part of the rule of law, so Kosovo must adhere to it”, Stano has added.
Respecting the law right now, according to Stano, is important considering how fragial the situation is in the field.
“The situation is now very fragile, we are in a volatile situation. Kosovo and Serbia must refrain from unilateral actions”.
Disrespecting the constitution would lead to increasing tensions. Let me repeat the call of the European Union and the calling of the 27 member states that both sides work immediately on returning Serbs to Kosovo institutions in line with agreements stemming from the” dialogue.
Unlike Kosovo's prime minister, Albin Kurti, on Thursday, had named Nenad Rasicić, Minister for Communities and Kthim in the Government of the Republic of Kosovo.
Rasic comes to this position as a replacement for resignation, Goran Rakic.
Rasic takes over Goran Rakic, who had resigned from the minister's position.
On the other hand, the appointment in question has not welcomed the Serbian List.
Rasic's appointment as minister without the consent of Serbian deputies, according to the Serbian List, is unconstitutional.
“Concretically, with this appointment, Albin Kurti has violated Article 96, paragraph 5 of the Constitution, where it says that the appointment of a minister from the ranks of the Serbian people, who are not deputies, should be consented to the majority of Serbian deputies, whom Albin Kurti has not, nor Rassic has the support of our deputies”, says in the reaction of the Serbian List.
