The news.net has secured full testimony from former EULEX judge Malcolm Simmons on his alleged scandals in the European Union's legislative mission.

In his testimony, Simmons makes serious claims that EULEX judges have travelled to Serbia several times, and have even brought war crimes files there. Even Simmons in his testimony says the mission did not trust the local judges in Kosovo, as according to him, “perception” that they would not convict former KLA officials who were being tried at the time.

The majority of Kosovo's local Judges was not entrusted within the Mission. There was a widespread perception within the Mission that if local judges had access to sensitive information they would reveal such information. There was also a feeling that local judges would not convict any U soldier CK or any high profile defendants with Albanian origin. The Panel Equipment was carefully examined to ensure that, in cases, it was important for the Mission, to have most EULEX Judges and those judges would be entrusted with the plea”, Simmons says at one of the points in his report.

Simmons further says that in addition to judges, there was pressure on EULEX prosecutors to investigate cases involving high profilers, even though there may have been no facts against them.

And Simmons' claims do not stop only in the EULEX mission. According to him, the EU's dissatisfaction with former Special Chief David Scheendjman had led to his replacement.

First reasons, Simmons cited the fact that the EU considered Schendimann to be not finding evidence against KLA leaders.

The former chief judge also cites serious interference in important criminal processes, which were being investigated by EULEX.

He says witnesses on several occasions “were promised the world” in exchange for their testimony. They were told they would be accommodated in an EU state.

Scandals claimed in EULEX by Simmons include behaviors that exceed any rate of professional ethics by judges.

In one case, always according to Simmons, in the midst of a rape trial, the EULEX Judicial Chamber judge had visited the victim in her home to hear her testimony. But neither the prosecutor nor the lawyer were present.

A EULEX judge in Mitrovica approached in October 2014. He told me of the bad behavior in which EULEX judges in Mitrovica were involved. These included a EULEX judge who had carried out an identification process in her office, in the midst of the trial, with the defendant and defence lawyer, but without the prosecutor's presence. In the second case, in the midst of a rape trial, the chairman of EULEX's court has visited the victim in her home so that she can hear her testimony. Neither the lawyer nor the prosecutor have been present”, claims it's just Simmons.

In addition, according to Simmons, among all the interventions in the processes, EULEX judges in Kosovo also took time to take prostitutes for their personal entertainment.

“There were many issues involving the professionalism of EULEX judges, which I had noticed. They behaved from taking prostitutes from EULEX judges to the verbal confrontations of EULEX judges with local judges, which included claims of attack, and until the participation of EULEX judges in court. I launched a system for monitoring the fulfillment of EULEX judges, which was unpopular among many EULEX judges. A EULEX judge told me it was his job to come to court or not and that this was judicial independence. My analysis of the fulfillment of EULEX judges found that, on average, they were in court three days a month and carried out judicial procedure less than five days a month”, it says, in Simmons testimony.
