A comprehensive law struggle for Peter Ndrecjt's sentence that killed his wife and daughter

On the other hand, the Constitutional Prosecutor in Pristina has again demanded that accused Ndociaj be sentenced to life in prison, as according to this prosecutor, the sentence pronounced by the first degree was low.

Ndekaj was originally sentenced by the Constitutional Court in Gjakova on November 2nd 2018, to 24 years in effective prison for the murder of his wife and daughter, but the Court of Appeals, in March 2019, had changed the first degree verdict and sentenced him to life imprisonment.

However, the Supreme Court of Kosovo had broken both acts and the case had turned into retrial.

After returning the case to the retrial, the Constitutional Court in Gjakova, for the second time, had found Rudecajn guilty, condemning him to 24 years and 6 months in prison for serious murder and illegal weapons.

Shrug for illegal weapons of arms were sentenced to one year in prison, while for killing 24 years in prison. However, his sentence had been pronounced unique in length for 24 years and six months in prison.

Disgusted with that decision, the complaint at the Appeals Court had been filed by the Constitutional Prosecutor in Pristina, the representative of the damaged party, lawyer Isa Osdautaj, and defender of accused Ndecaj, lawyer Ndek Dodaj.

These complaints by the parties have been reviewed by the Court of Appeals on Friday, reports “Justice Vow”.

In her complaint, the Constitutional Prosecutor in Gjakova has stressed that the first degree ruling was mild, and according to the prosecution, the court had to make a higher decision as the one in life imprisonment, given public opinion response.

The complaint over the penalty has also been filed by the representative of the damaged party, lawyer Isa Osdautaj, who, according to him, was very mild in his decision as it was about the murder of the minor wife and daughter.

Due to substantial violations of the Criminal Procedure Code, mistaken confirmation of the actual situation and violation of criminal law, the complaint also prompted the defender of accused Ndecaj, lawyer Ndek Dodaj.

“Mbes in the complaint claims, the focus on this complaint has been on the will, I've opened the dilemma of whether or not there was a direct wish or not because the expertise was not complete, they didn't refer to the circumstances the court himself asked, even though the expert has been given an expert that proves that the defendant has had problems of this nature, even before 2016, all of these are Astrahus, and there have been other excesses that he has made of the first instance, especially, because we have made a victim of a very young age, with no intentional intent, of making many or large demands that he has committed himself to a direct murder of the child, while there has been no known to a direct murder, and there has been no evidence of any evidence of a direct murder of the child.

While, accused Peter Ndekaj has remained on the whole near the demand exercised by his defender.

Otherwise, according to the indictment, the accused on August 7, 2018, in Gjakova, at the home of the victim's family, has deliberately deprived his wife V. N, and his daughter K.N.

The accused allegedly went to the house of the armed victim's brothers, where he shot the automatic rifle in the direction of the house, and shot his ex-wife and daughter, the same wounds have changed their lives.

The Gjakova Constitutional Prosecutor has filed charges against Peter Ndociaj because of the criminal act “heavy murder” by 179 paragraph 1 subparagraph 1.1, 1.3 and 1.11 of KPRK, and for criminal work “control or authorised possession of weapons” from Article 374 paragraph 1 of KPRK.
