Former Drinas Chairman Nexhat Demaku acquitted of abuse of duty

The former head of Drenas, Nexhat Demaku and former director of education in this municipality, Sadik Tahiraj, have been acquitted of abuse of duty.

The indictment against them was announced Tuesday by the chairman of the court, Judge Hope-Heysen, reports “Justice Vow”.

Demak is being accused of having issued the act of appointment to the employee Berisha, in an inspector market position, without announcing public competition, without signing to the recruiting-employment procedures, bringing rich benefits to the value of 18,309.01 euros, with what had damaged the municipality budget.

While Tahiraj is accused of having issued the contract for primary educators at the Lower Middle School “Ali Gashi<1> in Drenas, without having announced public competition, and had hired her without adequate school preparation, where she had subsequently handed her the decision to transfer to the Directorate of Inquest, as market inspector, damaging the municipality budget worth 756 euros.

Judge Hope Hasay-Hysen has said it has not been proven that Demaku and Tahiraj have committed the criminal offence they are in charge of.

According to her, it has not been confirmed that by the actions of the accused, damage has been done to the Drenas Town.

The damaged side, however, has been instructed in regular civil conflicts

According to the indictment filed on September 27, 2018, Nexhat Demak is accused of exploiting official office as chairman of the Drenas municipality, overcoming his powers with the aim of illegally benefiting property for himself or the other person.

He is charged that on March 10th 2015, he has issued the act of appointment to employee Mimoza Berisha in the market inspector position at the Inspection Directorate, the Kernassian municipality of March 5th 2015 to March 5, 2016, as well as January 20, 2016, in length of March 5, 2015, to June 5, 2018.

This act of appointment, Demak is accused of having issued it to Berisha, the Darnas Community Inspectorate Directorate, with the title of the country's inspector work and market, without having announced public competitions, failing to undergo recruiting-employment procedures.

The prosecution for his move claims Berisha had brought illegal property benefits of 18.309.01 euros, while at that value the Drensian municipality has also been damaged.

Regarding Berisha's employment, the prosecution also claims to have misused the post, as well as former director of the Directorate of Education in the Drinas municipality, Sadik Tahiraj.

He is charged that on November 3rd 2014, he has issued the employment contract for teaching Mimoza Berisha with the job title, pre-eminent educators at the Lower High School “Alia Gashi” in Drenas, as well as on November 3, 2014 had issued the decision to her, in her education position, without public competition announced, and had hired her without adequate school preparation, not subjecting her to draft-employment procedures.

Always in accordance with the indictment on March 5th 2015, he had issued Berisha's decision on transferring her to the Crenasium Directorate in the Workplace of Market Inspector, and with what was done by Berisha had brought illegal benefits worth 756.18 euros, causing both the municipality budget worth 756.18 euros.
