The First Stair Court in Durres set him free on 11 July. Reason? No extradition request.
The prosecutor of the case argued there was a warrant for arrest, and Hatija was to remain in prison for 40 days, pending extradition request.
But the court refused. She released the 45 - year - old man, in whose footsteps Italian authorities were falling after two years of research.
The prosecution will appeal the verdict, but in the meantime Hatija is free.
Hatija was arrested in Durres while visiting a friend.
He lived isolated in a bunker - related house and was taught that he had also paid armed men to guard him.
According to Italian media, he was convicted on charges that by 2003 period 2004 he had trafficked 350 kilograms of heroin and 190 kg of cocaine to Milan. The value of drugs is estimated at 35m euros and 45m euros.
