Morina apareció hoy en la Corte, mientras que la Fiscalía Especial había anunciado su detención esta semana.
The court emphasises there is suspicion that, on March 31st 1999, the defendant R.M. had been participating in crimes committed in the village of Burim of Malisheva, as well as allegedly on the same date, had participated in the killing of 34 victims of this village.
En su razonamiento de detención, el tribunal dice que si Morina fue puesto en libertad, podría escapar, ya que el mismo tiene ciudadanía y residencia permanente en Serbia.

Special Department has assigned the detention measure to indictees R.M., suspected of war crimes against the civilian population.
The Constitutional Court in Pristina, the Special Department, has approved the request of the Special Prosecutor of the Republic of Kosovo, and through the Act has appointed the detention measure of (1) a month to indictees R.M., due to the suspicion of having committed criminal crimes against the civilian population.
El juez de procedimiento preliminar, después de la audiencia, aprecio que se hayan cumplido las condiciones legales para nombrar la medida de detención del acusado R.M., ya que hay sospechas de que la misma coordinación ha cometido los crímenes de guerra contra la población civil.
There is doubt that by March 31st 1999, the defendant R.M. had been participating in crimes committed in the village of Burim of Malisheva, as well as allegedly that on the same date, he had participated in the killing of 34 victims of this village.
The court estimates that the burden of criminal acts is of serious and complex nature, so the appointment of the detention measure is necessary in this criminal case and that any other measure would be insufficient for successful implementation of the criminal procedure.
El tribunal considera que hay sospechas basadas en el acusado R.M. Si se encuentra en libertad, puede evitarse en vista de que tiene la ciudadanía de Serbia, tiene residencia permanente en Serbia, por lo que es posible que pueda escapar y que lo mismo podría ser difícil para otras fases del procedimiento penal, la Corte también considera que si el acusado se queda en libertad plantea un peligro real de que lo mismo pueda identificar testigos y ejercer influencia en el mismo.
En contra de este acto, las partes descontentas tienen derecho a presentar una denuncia ante el Tribunal de Apelaciones, por conducto del Tribunal Constitucional de Pristina.
